Regarding residential landlord-tenant relationships.
(DIGEST OF PROPOSED 1ST SUBSTITUTE)
Provides that, when a tenant, after the exercise of due diligence, is unable to ascertain the physical location of a landlord by the statement of the landlord's address in the rental agreement, by the notice conspicuously posted on the premises, or as notified by certified mail, and service of a legal document is deemed necessary, the tenant may provide service upon the landlord by using both certified mail and regular mail either to the address listed on the property owner's current tax statement for the property being rented by the tenant, to the address provided to the tenant for payment of rent, or to the address provided to the tenant for service of notice or process, and a court having jurisdiction over the matter under RCW 59.18.050 shall deem such service to be adequate notice of the action.

Eliminating barriers to initial licensure in health professions.
(DIGEST OF PROPOSED 1ST SUBSTITUTE)
Finds that the health care work force shortage is contributing to the health care crisis.
Finds that some unnecessary barriers exist that slow or prevent qualified applicants from becoming credentialed health care providers.
Declares that eliminating these initial barriers to licensure will contribute to state initiatives directed toward easing the health care personnel shortage in Washington.
Provides that a licensed practical nurse with an active license who is in the process of completing or has completed the coursework of a nontraditional registered nurse program approved by the commission can obtain the required clinical experience when: (1) The experience is obtained under the immediate supervision of a registered nurse who agrees to act as the preceptor with the understanding that the licensed practical nurse is practicing under the preceptor's registered nurse license. The preceptor must have an unrestricted license with at least two years of clinical practice in the same type of practice setting where the preceptorship will occur; and
(2) The experience is obtained within six months of completion of the approved nontraditional program.

Concerning the distribution and use of funds provided to off-road vehicle and nonhighway road recreational activities.
Provides that, beginning January 1, 2013, and updated every ten years thereafter, the interagency committee for outdoor recreation shall contract with an independent entity to study the source and make recommendations on the distribution and use of funds provided to off-road vehicle and nonhighway road recreational activities under this act. The study must determine the relative portion of the motor vehicle fuel tax revenues that are attributable to vehicles operating off-road or on nonhighway roads for recreational purposes as provided in this act. The study must include the types of vehicles and location of their use, the types of recreational activities, the types of recreational facilities used, and the recreational use of forest roads relative to other, nonrecreational uses.

Declares that in the interest of recruiting and retaining qualified instructional staff in all regions of the state, and of ensuring continuous compliance with Article IX, section 2 of the state Constitution, that basic education salary allocations should be adjusted on an ongoing basis for differences in the cost-of-living among regions of the state, as determined through a rigorous method of economic analysis.

Providing tax incentives to promote the production and distribution of electricity from alternative sources of energy.
Declares an intent to encourage and expand the commercial generation of electrical power from alternative energy sources to meet the long-term energy needs of the state.
Intends that incentives provided by the state encourage free-market principles that foster technological innovation and entrepreneurial investment in alternative energy sources. This intent is best served by encouraging commercially viable, independent generators of alternative energy-based electrical power to provide such power to established utility distribution networks, including investor-owned utilities and public utility districts.
Declares an intent to promote the use of alternative energy sources for the purpose of electrical generation, tax incentives should be provided in RCW 82.08.02567 and 82.12.02567 for the acquisition of certain machinery and equipment to all qualifying sectors of the state economy, including industrial, commercial, and residential.

Provides that the department shall direct the payment of the installments of public assistance to any reasonable person, social service agency, or corporation, if the person receiving public assistance has failed to pay rent by the due date provided for in the rental agreement two or more times in a twelve-month period, commencing with the date of the first violation, after service of a three-day notice to comply or vacate under the provisions of RCW 59.12.030(3).

Funding tire recycling.
Creates the vehicle tire recycling account within the state treasury. After the deposit of funds into the motor vehicle account as provided for in RCW 70.95.510(3), the remaining funds received under RCW 70.95.510(1) must be deposited in the vehicle tire recycling account and used by the department of ecology for purposes including but not limited to those specified in RCW 70.95.535.
Authorizes the department of revenue to deduct two percent from the funds collected under RCW 70.95.510 for the purpose of administering and collecting the fee from new replacement tire retailers.
Authorizes use of the funds for: (1) Scrap tire demonstration projects including those implemented by state agencies;
(2) Statewide illegal tire pile cleanups, as provided for in RCW 70.95.240(2)(c), and local citizen scrap tire amnesty events;
(3) Statewide tire carrier tracking, reporting, and enforcement of the movement of tires within this state.
Requires local governments that are recipients of the enforcement program grant funding to submit an annual report to the department of ecology for each year the grant funding is expended, detailing the uses of the funds and including information on what enforcement activities were supported with the grant funds.

Revising environmental review provisions to improve the development approval process and enhance economic development.
Declares that proposed essential public facilities identified according to RCW 36.70A.200 may not be conditioned on the payment of a fee under this act to mitigate a specific adverse environmental impact, if an impact fee, as defined in RCW 82.02.090, could be imposed according to RCW 82.02.050 through 82.02.090 to mitigate that specific adverse environmental impact.
Provides that, in urban growth areas in which existing density and intensity is lower than the levels called for in the goals and policies of applicable comprehensive plans adopted according to chapter 36.70A RCW, in order to accommodate infill development and thereby realize the goals and policies of the comprehensive plans, the rules shall provide for categorical exemptions for higher levels of density and intensity of new development than the categorical exemption levels provided for all other areas.
Provides that in situations where all adverse environmental impacts will be mitigated below the level of significance as a result of voluntary measures by the proponent and/or regulatory requirements of development regulations adopted under chapter 36.70A RCW or other local, state, or federal laws, a determination of nonsignificance or a mitigated determination of nonsignificance is the proper threshold determination.

(2) Proportionately by liveable square footage;
(3) Per type of unit;
(4) Per number of water fixtures; or
(5) Any other method that fairly allocates the charges.

Recognizes that minors often have multiple needs and it is important to provide uniform and compatible treatment to minors for their mental, emotional, and physical needs. There is a need to provide uniform prevention and treatment services for the needs of minors who are suffering from illness or other destructive patterns of behavior such as alcohol or drug addiction.
Provides that no public or private agency or governmental entity, nor officer of a public or private agency, nor the professional person in charge, his or her professional designee or attending staff of any such agency, nor any public official performing functions necessary to the administration of this act, nor peace officer responsible for detaining a person under this act, nor any designated chemical dependency specialist, nor treatment program, shall be civilly or criminally liable for performing his or her duties under this act with regard to the decision of whether to admit, release, or detain a person for evaluation and treatment: PROVIDED, That such duties were performed in good faith and without gross negligence.

Provides that the educational assistance grant program for students with dependents grants may be used by eligible participants to attend any public or private college or university in the state of Washington as defined in RCW 28B.10.802. The participant is not eligible for a grant if the grant will be used to pursue a degree in theology.

Declares that trafficking in the first degree is a class A felony.

Declares that, while the marketplace appears to operate effectively for conventional mortgages, too many homeowners find themselves victims of overreaching lenders who provide loans with unnecessarily high costs and terms that are unnecessary to secure repayment of the loan.
Finds that as competition and self-regulation have not eliminated the abusive terms from home-secured loans, the consumer protection provisions of this act are necessary to encourage lending at reasonable rates with reasonable terms.

Requires a licensee to provide, prior to the closing of a residential mortgage loan, a notice to each borrower of the annual percentage rate of the loan and whether or not the loan has a prepayment penalty.

Modifying regional transit authority provisions.
Provides that, after July 1, 2003, for financing and project purposes, any area annexed shall be included in the most appropriate subarea of the five subareas identified in the authority's system plan adopted in May 1996. When annexed, taxes from an area joining the authority must be used only for projects, facilities, and services within that subarea.
Requires that authority tax revenue must be allocated proportionally to the subareas based on the share of tax revenues each subarea generates. This determination shall be made according to a reasonable method which may require estimates or other approximate methods. The tax revenue allocated to a subarea shall be used to finance costs incurred for projects within the subarea.
Provides that, after July 1, 2003, revenue bonds may be issued only to fund projects within one subarea and shall pledge only revenue derived within the subarea.
Provides that, after July 1, 2003, the proceeds from the issuance of general obligation bonds must be used to finance projects, services, or facilities within one chosen subarea. As part of the bond financing plan, the authority shall indicate how the proceeds from the issuance of general obligation bonds will be apportioned between the five subareas. The authority shall maintain five separate accounts for the deposit of proceeds that are to be used in the five subareas.
Provides that, after July 1st, special assessment or revenue bonds may be issued only to fund projects within one subarea as identified in an authority's system plan adopted in May 1996 and shall pledge only revenue derived within the subarea.
