Creating the state financial aid account.

(DIGEST OF PROPOSED 1ST SUBSTITUTE)

       Declares that the primary purpose of the account is to ensure that all appropriations designated for financial aid through statewide student financial aid programs are made available to eligible students. The account shall be a nontreasury account.

       Directs the higher education coordinating board to deposit in the account all money received for the state need grant program established under RCW 28B.10.800, the state work-study program established under chapter 28B.12 RCW, the Washington scholars program established under RCW 28A.600.110, the Washington award for vocational excellence program established under RCW 28C.04.525, and the educational opportunity grant program established under chapter 28B.101 RCW.

Allowing out-of-state licensees to practice commercial real estate.

(DIGEST OF PROPOSED 1ST SUBSTITUTE)

       Provides that an out-of-state broker, for a fee, commission, or other valuable consideration, or in the expectation, or upon the promise of receiving or collecting a fee, commission, or other valuable consideration, may perform those acts that require a license under chapter 18.85 RCW, with respect to commercial real estate, provided that the out-of-state broker does all of the following: (1) Works in cooperation with a Washington real estate broker who holds a valid, active license issued under this chapter;

        (2) Enters into a written agreement with the Washington broker that includes the terms of cooperation, oversight by the Washington broker, compensation, and a statement that the out-of-state broker and its agents will agree to adhere to the laws of Washington;

        (3) Furnishes the Washington broker with a copy of the out-of-state broker's current license in good standing from any jurisdiction where the out-of-state broker maintains an active real estate license;

        (4) Consents to jurisdiction that legal actions arising out of the conduct of the out-of-state broker or its agents may be commenced against the out-of-state broker in the court of proper jurisdiction of any county in Washington where the cause of action arises or where the plaintiff resides;

        (5) Includes the name of the Washington broker on all advertising in accordance with RCW 18.85.230(8); and

        (6) Deposits all documentation required by this act and records and documents related to the transaction with the Washington broker, for a period of three years after the date the documentation is provided, or the transaction occurred, as appropriate.

Creating programs to promote prevention of child abuse and neglect.

       Directs the department of social and health services to establish and implement uniform criteria for funding prevention and early intervention services and programs that are either state-operated or contracted. The uniform funding criteria must mandate that all funded programs, at a minimum: (1) Define clear, measurable outcomes;

       (2) Are research-based;

       (3) Can demonstrate their anticipated cost-effectiveness;

       (4) Can demonstrate broad community involvement, support, and partnerships; and

       (5) Conduct an evaluation of their program outcomes.

        Requires the department of social and health services, the department of community, trade, and economic development, the department of health, the office of superintendent of public instruction, and the Washington council for prevention of child abuse and neglect to report to the appropriate fiscal and policy committees of the legislature by April 1, 2004, regarding the implementation of the funding criteria for prevention and early intervention services and programs required under this act.

        Recognizes the importance of evaluation and outcome measurements of prevention and early intervention programs in order to ensure the cost-effective use of public funds.

        Directs the Washington state institute for public policy to conduct a review of existing research to identify specific research-proven prevention and early intervention programs that produce a positive return on the dollar compared to the cost of the program. The Washington state institute for public policy shall also identify possible mechanisms for funding such programs.

        Requires the Washington state institute for public policy to report its findings to the appropriate committees of the legislature no later than January 1, 2004.

Creating the financial fraud alert act.

        Declares an intent to enable financial institutions and merchants, to the extent permitted by federal law, to exchange information for the purpose of preventing, detecting, deterring, and assisting in the prosecution of financial fraud, bank robbery, money laundering, and other financial crimes.

        Declares that this act provides immunity from liability for financial institutions and merchants who participate in a fraud alert network and who comply with the provisions of this act.

        Declares that it is the intent of this act to encourage the sharing of information consistent with federal law.

        Declares that a fraud alert network is intended to protect against or prevent actual or potential fraud, unauthorized transactions, claims, or other liability, and is intended to be exempt from privacy disclosure requirements of the Gramm-Leach-Bliley Act of 1999.

        Declares an intent that the Washington fair credit reporting act, chapter 19.182 RCW, does not apply to a fraud alert network. However, if it is determined that the federal fair credit reporting act applies to a fraud alert network, the Washington fair credit reporting act shall likewise be applicable.

Prohibiting manufacture or sale of fraudulent drivers' licenses and identicards.

        Declares that it is a class C felony for any person to manufacture, sell, or deliver a forged, stolen, fictitious, counterfeit, fraudulently altered, or unlawfully issued driver's license or identicard, or to manufacture, sell, or deliver a blank driver's license or identicard except under the direction of the department.

       Provides that, in a proceeding under this act that is related to an identity theft under RCW 9.35.020, the crime will be considered to have been committed in any locality where the victim resides, or in which any part of the offense took place, regardless of whether the defendant was ever actually in that locality.

       Provides that any provision of a contract between a merchant or retailer and a credit or debit card issuer, financial institution, or other person that prohibits the merchant or retailer from verifying the identity of a customer who offers to pay for goods or services with a credit or debit card by requiring or requesting that the customer present additional identification is void for violation of public policy.

        Provides that application forms for initial or renewal licensure, certification, or registration to a health care profession must contain a provision asking the applicant whether or not he or she grants permission to the department to forward his or her name, profession, and contact information to the military department as a possible volunteer resource to be contacted in the event of a bioterrorist incident, natural disaster, or other emergency or disaster, as defined in RCW 38.52.010, that requires the services of health care providers.

Limiting noneconomic damages in actions involving provision of health care.

        Provides that, in an action for damages for injury or death occurring as a result of the provision of health care, the amount of noneconomic damages awarded to the claimant shall not exceed four hundred thousand dollars.

        Does not apply in an action in which the acts or omissions of a defendant were reckless, willful, or wanton.

        Declares that this act takes effect if the proposed amendment to Article I, section 21 of the state Constitution limiting noneconomic damages in actions involving provision of health care is validly submitted to and is approved and ratified by the voters at the next general election. If the proposed amendment is not approved and ratified, this act is void in its entirety.

Awarding credits against medical malpractice insurance rates for patient safety activities.

       Directs the department, in consultation with the office of the insurance commissioner, to develop and adopt criteria in rule for approval of medical error reduction programs. In developing criteria, the department shall rely heavily upon evidence-based practices to improve patient safety that have been identified and recommended by governmental and private organizations, including but not limited to: (1) The federal agency for healthcare quality and research;

       (2) The federal institute of medicine;

       (3) The joint commission on accreditation of healthcare organizations; and

       (4) The national quality forum.

       Provides that, beginning January 1, 2004, as part of any rate filing under RCW 48.19.040 submitted to the commissioner, insurers shall file with the commissioner a credit against the rate or rates applicable for medical malpractice coverage for physicians, hospitals, other health care professionals, or other health care facilities to reflect the initiation of a medical error reduction program or programs that have been approved by the department of health under this act.

       Directs the board to facilitate ongoing collaboration among stakeholders in order to address the health care personnel shortage. The stakeholders shall: (1) Establish and maintain a state strategic plan for ensuring an adequate supply of health care personnel that safeguards the ability of the health care delivery system in Washington state to provide quality, accessible health care to residents of Washington;

       (2) Develop and implement a work force data collection and analysis system to assess health care work force supply and demand; and

       (3) Report to the governor and legislature by December 31, 2004, and by December 31, 2006, on progress on the state plan and make additional recommendations as necessary.

        Declares an intent that Washington join as a member state in the streamlined sales and use tax agreement referred to in chapter 82.58 RCW. The agreement provides for a simpler and more uniform sales and use tax structure among states that have sales and use taxes.

        Declares an intent to bring Washington's sales and use tax system into compliance with the agreement so that Washington may join as a member state and have a voice in the development and administration of the system, and to substantially reduce the burden of tax compliance on sellers.

        Does not include changes to Washington law that may be required in the future and that are not fully developed under the agreement. These include, but are not limited to, changes relating to online registration, reporting, and remitting of payments by businesses for sales and use tax purposes, monetary allowances for sellers and their agents, sourcing, and amnesty for businesses registering under the agreement.

        Declares an intent that the provisions of chapters 82.08 and 82.12 RCW be interpreted and applied consistently with the agreement.

        Requires the department of revenue to report to the fiscal committees of the legislature on January 1, 2004, and each January 1st thereafter, on the development of the agreement and to recommend changes to the sales and use tax structure and propose legislation as may be necessary to keep Washington in compliance with the agreement.

Funding replacement ferries through digitally printed license plates.

       Directs the department to implement a flat, digitally printed license plate system that must be used to manufacture all license plates issued under chapter 46.16 RCW. This system must be in place and operational by July 1, 2004, and the system must be used to produce all license plates issued under this chapter no later than July 1, 2011.

       Declares that, in providing for the periodic replacement of license plates, the department shall offer vehicle owners the option of retaining their current license plate numbers. The department shall charge a retention fee of twenty dollars if this option is exercised by a vehicle owner. Revenue generated from the retention fee will be deposited into the steel electric ferry replacement account.

       Creates the steel electric ferry replacement account in the motor vehicle fund. All moneys deposited in the account are subject to the following conditions: (1) All funds will be used by the department of transportation for replacing the steel electric class of ferries, including the design, construction, and financing of a new class of ferry;

       (2) The department of transportation will use these funds to maximize the benefit to the taxpayer;

       (3) The department of transportation will pursue all financing opportunities available in order to make the best use of these funds; and

       (4) Use of these funds must adhere to the legislative intent of chapter 226, Laws of 2001.

       Provides that the treasurer shall never transfer any moneys from the steel electric ferry replacement account for use by the department of transportation for state highway purposes so long as there is due and unpaid obligations for payment of principal, interest, sinking funds, or reserves as required by any pledge of the steel electric ferry replacement account.

Improving patient safety practices.

       Requires the secretary to increase the licensing fee established under RCW 43.70.110 for health care professionals and facilities designated in this act by one percent of the amount of the applicable annual licensing fee. Proceeds of the patient safety fee must be dedicated to patient safety and medical error reduction efforts that have been proven to improve the quality of care provided by health care professionals and facilities.

       Provides that one percent of the present value of the settlement or verdict in any action for damages based upon injuries resulting from health care shall be deducted from the settlement or verdict as a patient safety fee. Proceeds of the patient safety fee will be distributed by the department of health in the form of grants, loans, or other appropriate arrangements to support strategies that have been proven to reduce medical errors and enhance patient safety as provided in this act.

       Creates the patient safety account in the custody of the state treasurer. All receipts from the fees created in this act must be deposited into the account.

       Declares that low interest loans and other alternative financing arrangements are needed to help small businesses, nonprofits, and other qualified entities purchase the assistive devices and services and make the program and building access modifications needed to fully include individuals with disabilities.

        Declares that the state of Washington has a compelling interest in regulating sober living homes in the state to ensure the homes comply with all state and local laws governing building, fire, safety, health code as well as zoning standards, and traffic regulations.

        Requires that sober living homes shall be maintained internally and externally in good repair and condition. Such homes shall have safe and functioning systems for heating, cooling, hot and cold water, electricity, plumbing, garbage disposal, sewage, cooking, laundry, artificial and natural light, ventilation, and any other feature of the home as required by state and local regulations, statutes, or ordinances.

        Requires each sober living home to meet applicable local licensing, zoning, building, and housing codes, and state and local fire safety regulations as they pertain to a single-family residence. It is the responsibility of the home to check with local authorities to ensure all local codes are met.

        Requires that an order terminating the parent and child relationship shall include a statement addressing the status of the child's sibling relationships pursuant to RCW 13.34.130(3). The order shall state who the child's siblings are, in whose custody they remain or have been placed, and unless the court has determined that there is reasonable cause to believe the health, safety, or welfare of the child or sibling would be jeopardized by contact or visitation it shall be presumed that such contact or visitation is in their best interest.

        Provides that the custodian shall ensure that a child with siblings is either placed with them or enabled to contact or visit them unless the court has determined that the health, safety, or welfare of the child or siblings would be jeopardized.

Revising method for making distributions under the municipal criminal justice assistance account.

        Amends RCW 82.14.330 to provide that ten percent shall be distributed on a per capita basis to cities that contract with another governmental agency for the majority of the city's law enforcement services.

        Provides that fifty-four percent shall be distributed to cities and towns by the state treasurer on a per capita basis. These funds shall be used for: (1) Innovative law enforcement strategies;

        (2) Programs to help at-risk children or child abuse victim response programs;

        (3) Programs designed to reduce the level of domestic violence or to provide counseling for domestic violence victims; and

        (4) Contracted law enforcement services provided by another governmental agency.

        Repeals RCW 82.14.335.

Implementing the streamlined sales and use tax agreement.

       Declares an intent that Washington join as a member state in the streamlined sales and use tax agreement referred to in chapter 82.58 RCW. The agreement provides for a simpler and more uniform sales and use tax structure among states that have sales and use taxes.

       Declares an intent to bring Washington's sales and use tax system into compliance with the agreement so that Washington may join as a member state and have a voice in the development and administration of the system, and to substantially reduce the burden of tax compliance on sellers.

       Does not include changes to Washington law that may be required in the future and that are not fully developed under the agreement. These include, but are not limited to, changes relating to online registration, reporting, and remitting of payments by businesses for sales and use tax purposes, monetary allowances for sellers and their agents, sourcing, and amnesty for businesses registering under the agreement.

       Declares an intent that the provisions of chapters 82.08 and 82.12 RCW be interpreted and applied consistently with the agreement.

       Requires the department of revenue to report to the fiscal committees of the legislature on January 1, 2004, and each January 1st thereafter, on the development of the agreement and to recommend changes to the sales and use tax structure and propose legislation as may be necessary to keep Washington in compliance with the agreement.

       Finds that: The state's highly productive and efficient agriculture sector is composed predominately of family owned and managed farms and an industrious and efficient workforce; the supreme court has directed the department of labor and industries to initiate rule making regarding routine monitoring of agriculture workers who are exposed to certain pesticides.

       Declares it is the intent of this act to guarantee that the safety and health of workers is protected, and this can best be accomplished through pilot project rule making to determine whether mandatory medical monitoring is beneficial to workers and feasible considering all of the technical requirements of such a regulation.

        Provides that, in order to ensure that major construction projects involving the use of large quantities of fill material do not pose a threat to water quality, the department shall require that the chemical suitability of potential fill material be determined through use of a leaching test of the type specified in WAC 173-340-747(7), as it existed on January 1, 2003, in all water quality certifications issued under section 401 of the federal clean water act and administrative orders issued under chapter 90.48 RCW where such certification or administrative order authorizes the placement of more than two million cubic yards of fill material, some or all of which will be placed in waters of the state.

       Provides that, prior to implementing any medicaid case mix payment method for licensed boarding homes, on a statewide basis, the department shall develop and implement a pilot program.

       Declares that the pilot program will test the validity of the comprehensive assessment tool; identify the providers' actual costs of providing care and services related to each care payment level; and test the adequacy of case mix payment rates for each of the care payment levels.

       Provides that, by December 12, 2004, the department shall report the results of the case mix payment system pilot program to the chairs of the health care committees of both houses of the legislature.

        Declares that this act takes effect January 1, 2004, if the proposed amendment to Article II, section 15 of the state Constitution (HJR --) is validly submitted to and is approved and ratified by the voters at a general election held in November 2003.        Directs the superintendent of public instruction to develop valid and reliable multiple measures, which may include but not be limited to, the Washington assessment of student learning, a portfolio of evidence, high school grade point average, and academic and vocational evaluations. The superintendent of public instruction shall adopt these measures by rule not later than July 1, 2004.
