Creating a statewide justice information network.

(DIGEST OF PROPOSED 1ST SUBSTITUTE)

       Declares that the purpose of this act is to develop and maintain, in a cost-effective manner, a statewide network of criminal justice information that enables sharing and integrated delivery of justice information maintained in the state's independent information systems and that will: (1) Maximize standardization of data and communications technology among law enforcement agencies, jails, prosecuting attorneys, the courts, corrections, and licensing;

       (2) Reduce redundant data collection and input efforts;

        (3) Reduce or eliminate paper-based information exchanges;

       (4) Improve work flow within the criminal justice system;

       (5) Provide complete, accurate, and timely information to criminal justice agencies and courts in a single computer session; and

       (6) Maintain security and privacy rights respecting criminal justice information.

       Requires the board to file a report with the governor, the supreme court, and the chairs and ranking minority members of the senate and house committees with jurisdiction over criminal justice funding and policy by September 1, 2004, and not less than every two years thereafter. The report shall include specific goals for improving criminal justice information systems integration, a timeline and identifiable benchmarks for achieving those goals, and recommendations concerning legislative changes and appropriations needed to implement, operate, and enhance a statewide justice information network to assure the availability of complete, accurate, and timely justice information.

Providing a specific funding mechanism for making community and technical college faculty salary increment awards.

(DIGEST OF PROPOSED 1ST SUBSTITUTE)

       Directs community and technical college boards of trustees to award faculty salary increments based on local agreements developed under chapter 28B.52 RCW. Each biennium, the state board for community and technical colleges shall submit in its biennial budget request an amount of funds, which together with faculty turnover savings, is sufficient to cover the projected costs of increments for the community and technical college system.

       Directs the state board for community and technical colleges to convene a task force comprised of representatives from the state board, the presidents' organization, the trustees' organization, and the faculties' organization as defined by RCW 28B.52.020(7), to advise the state board on guidelines for the fair and equitable distribution of increment funds.

        Provides that, by December 1st of each year, agencies receiving these funds shall report to the standing committees of the house of representatives and the senate having responsibility for gambling policy on the expenditure of these funds and the status of the treatment supported by these funds.

       (2) Identifying ways to eliminate operational problems experienced by providers and managed health care plans;

       (3) Clearly defining operational expectations of managed health care plans;

       (4) Following existing industry standards, where applicable, rather than creating their own; and

       (5) Where state-purchased health care programs have similar functions, carrying out those functions in similar ways.

       Provides that no person shall make a delivery sale of tobacco products to any individual who is a minor.

       Requires each person taking a delivery sale order to comply with: (1) The age verification requirements set forth in this act;

       (2) The disclosure requirements set forth in this act; and

       (3) The shipping requirements set forth in this act.

       Designates penalties for violations of this act.

       Provides that, except as provided in this act, beginning January 1, 2003, self-service displays of tobacco products are prohibited. All in-store tobacco products must be sold from behind the counter or from within locked display units, or from any other location that a customer does not have access to without the assistance of the retailer.

       Provides that packages of fewer than twenty cigarettes may be sold only in premises where minors are prohibited by statute.

        Provides that one precinct committee officer position will be designated by number for each five hundred active registered voters and one additionally designated by position number for every major portion of five hundred active registered voters in a precinct.

        Provides that, for the purpose of determining the number of precinct committee officer positions allocated to each precinct, the county auditor shall use the number of active registered voters resident in the precinct as of thirty days before the first day for candidates to file a declaration of candidacy for public office in even-numbered years.

        Requires reports from state agencies to the legislature to be provided in an electronic format to the chief clerk of the house of representatives and the secretary of the senate. The chief clerk of the house of representatives and the secretary of the senate shall provide an online site for reports submitted to the legislature on the legislative internet home page. The reports shall be organized in such a way as to make the reports easy to find and accessible by legislators, staff, and the public.

Reducing the duplication of electric facilities.

       Provides that, where two or more electric utilities, as defined in RCW 19.29A.010(12), operate within a contiguous or overlapping geographic area, a city, town, or county legislative authority may require an agreement between the electric utilities to discourage and reduce the duplication of transmission lines and other appurtenances and to carry out the policy in RCW 54.48.020.

Concerning retail sales by the liquor control board.

       Directs the board to immediately devise a retail business plan to implement strategies to improve retail sales operations and maximize revenue-generating opportunities. Strategies to be implemented shall include but are not limited to: (1) Expanding hours of retail sales operations by including Sunday sales in liquor stores according to this act;

       (2) Implementing a plan of in-store merchandising, including point-of-sale advertising, and product specific point-of-sale promotional displays and carousels, including displays designed and provided by vendors;

       (3) Implementing a plan for in-store merchandising of brands and gift packs; and

       (4) Sales of liquor related items and products.

       Declares that the following is not considered advertising for the purposes of RCW 66.08.060: (1) Placement of signs that are visible through the window of retail stores;

       (2) Use of media designed to be informational regarding locations or hours of operation of retail outlets; and

       (3) In-store merchandising, including point-of-sale advertising, and product specific point-of-sale promotional displays and carousels, including displays designed and provided by vendors.

       Repeals RCW 66.16.080.

       Provides that no insurance company may require the use of nonoriginal equipment manufacturer crash parts in the repair of a motor vehicle for a period of five years running from the year the motor vehicle was manufactured or while the vehicle is under manufacturer's warranty unless the motor vehicle owner consents in writing at the time of the repair. If the motor vehicle owner consents to the use of nonoriginal equipment manufacturer crash parts, the insurer must specify on the repair estimate which parts are original equipment manufacturer crash parts and which parts are nonoriginal equipment manufacturer crash parts.

        (2) This practice, also known as "corporate expatriation," is part of a larger pattern of deception and lack of integrity in the corporate boardroom that has harmed the marketplace and investors;

        (3) An expatriate company is a United States based company that has moved in name and on paper only to a tax haven country and has no substantial business activities in the country of reincorporation;

        (4) These paper relocations result in a substantial weakening of shareholders' rights and significant tax avoidance; and

        (5) For these reasons, it is not in the best interests of the state and its citizens to use public funds to do business with publicly held expatriate companies.

       Directs the superintendent of public instruction, in consultation with the Washington state school directors' association, parents, and representatives of food service employee groups, to develop a policy to be implemented in all elementary schools for protecting children in preschool through fifth grade who assist in school kitchens.

       Requires that, by January 1, 2004, the superintendent of public instruction shall verify that all districts are implementing the policy and report to the legislature.

Limiting statutory authority for access to private property for governmental purposes.

(DIGEST OF PROPOSED 1ST SUBSTITUTE)

        Declares that the people of this state have a right to a reasonable expectation of privacy on their private property.

        Finds, however, that over time statutory authority for entry onto private property has expanded to the point where the people no longer feel secure from the unreasonable intrusion of government officials and others who have been granted special immunity from prosecution for trespass.

        Declares an intent, with certain limited and necessary exceptions, that all persons, whether government employees or private persons, be made subject to the same restrictions with regard to entering upon the property of another. It is the intent to eliminate special immunities from prosecution for trespass, whether those immunities have been legislatively granted to government or to private persons or entities.

       Declares it is not the intent to change the elements of the crime of trespass, but only to make all persons subject to the same law with exceptions from uniform application of that law only for the kinds of entries onto property by law enforcement officers that are lawful as of the effective date of this act and those entries onto property by government personnel that are specified in this act.

       Finds that not all mineral resources of long-term commercial significance can be used as construction aggregates and not all regions of the state have sufficient supplies of construction aggregates. As a result, projects may not be completed timely, economically, and with the quality of aggregates necessary for long-term durability.

       Creates a committee to study the state's need for aggregate.

       Requires the committee to: (1) Determine whether the goals and requirements under chapter 36.70A RCW are being met with regard to the identification, designation, and supply of aggregate necessary to meet the twenty-year comprehensive plans and whether sufficient quality and quantity of aggregate is available to meet the transportation elements of the department of transportation, county, city, or municipal projects, and private projects;

       (2) Determine whether environmental review procedures allow the efficient processing of permit applications without reducing environmental protection and without undermining the expectation that a successful project will receive a permit in a timely manner;

       (3) Ensure the state has competitive and efficient industries by evaluating and identifying areas of redundant, duplicative, and costly regulations and suggesting remedies to eliminate those inefficient impediments;

       (4) Consider how the aggregate and affiliated industries should be regulated; and

       (5) No later than December 15, 2003, prepare and submit to the legislature its findings and any legislation necessary.

Providing natural resource protection in Skagit county.

       Declares that the purposes of this act are: (1) To protect lands designated by the county as agricultural land of long-term commercial significance from the effects of saltwater intrusion and diminishment of drainage capability for drainage ditches and tide gates;

        (2) To require examination of opportunities to enhance tidal fish habitat on hundreds of acres of publicly owned land while maintaining habitat for migratory birds; and

        (3) To allow tide gates located on bona fide streams to proceed through a fish habitat restoration planning process to find opportunities to use fish habitat while avoiding harm to existing land uses.

        Provides that, from funds appropriated to the department of fish and wildlife for salmon restoration activities, the fish and wildlife commission, in coordination with the Skagit county legislative authority and diking district commissioners, shall jointly develop a strategy to enhance tidal fish habitat and address the management, operation, and maintenance of tide gates on streams in Skagit county while assuring no net loss of agricultural lands or their productivity. The strategy must be submitted to the appropriate standing committees of the legislature by December 1, 2004.

In order to improve the cost-efficiency of care at residential habilitation centers and begin to shift resources to expand community services, Fircrest School shall be closed during the 2003-2005 biennium.

        Directs the secretary of social and health services to develop and implement a transition plan that ensures that residents of Fircrest School shall be offered the choice of services at another residential habilitation center, community services, or, if appropriate, services in a skilled nursing facility. The proceeds from the eventual disposal of Fircrest property shall be deposited in the Fircrest legacy trust account established in this act.

        Repeals RCW 71A.20.030.
