Creating the state financial aid account.

(DIGEST OF PROPOSED 2ND SUBSTITUTE)

       Declares that the primary purpose of the account is to ensure that all appropriations designated for financial aid through statewide student financial aid programs are made available to eligible students. The account shall be a nontreasury account.

       Directs the higher education coordinating board to deposit in the account all money received for the state need grant program established under RCW 28B.10.800, the state work-study program established under chapter 28B.12 RCW, the Washington scholars program established under RCW 28A.600.110, the Washington award for vocational excellence program established under RCW 28C.04.525, and the educational opportunity grant program established under chapter 28B.101 RCW.

Authorizing instant runoff voting.

(DIGEST OF PROPOSED 1ST SUBSTITUTE)

       Finds that it is in the public interest to adopt a voting system in which all successful candidates must win by a majority vote rather than a plurality of effective votes and that allows voters to vote secondary and other preferences in case their favorite candidate does not receive a majority of the votes cast.

       Recognizes that the system known as instant runoff voting achieves that purpose.

       Finds that voter interest and participation in elections will increase by use of instant runoff voting because a voter has more choices and all votes will be more meaningful than votes under the present system. The legislature declares it is in the interest of participatory democracy that voters be given the opportunity to vote their true beliefs with their first choice votes, while still making effective secondary choices among the remaining acceptable candidates.

       Authorizes a pilot project to study the effects of using instant runoff voting as a local option for nonpartisan offices in charter cities.

       Directs the secretary of state to conduct a pilot project on the use of instant runoff voting as a local option for nonpartisan offices in charter cities. The pilot project must begin by August 1, 2003, and conclude no later than June 30, 2008.

        Provides that a city, town, or county that provides pretrial supervision or pretrial release, and any officer, employee, and volunteer of the city or town, is not liable for selecting one of two or more alternative courses of action pertaining to pretrial supervision or pretrial release even though the course of action chosen results in a poor outcome if the person exercised reasonable care and skill in arriving at the judgment to follow the particular course of action. For purposes of this act, "volunteer" is defined according to RCW 51.12.035.

Requiring a study of the state's education finance system.

(DIGEST OF PROPOSED 1ST SUBSTITUTE)

       Directs the office of financial management to conduct a comprehensive study of the Washington education finance system, including examination of alternative teacher compensation models.

       Provides that the study shall, at a minimum: (1) Compare Washington's common school funding system with those in other states that are beginning to link finance systems with education reform and expected student learning outcomes;

       (2) Review the role of state and local funding and levy equalization policies in the Washington common school finance system, building upon the 2002 joint task force on local effort assistance report; and

       (3) Design alternative common school finance systems for Washington.

       Provides that a twenty-three member steering committee shall direct the office of financial management in the system review and the development of alternatives and recommendations.

       Requires the office of financial management to report initial findings and recommendations of the committee to the legislature, including the education and fiscal committees of the house of representatives and the senate, by June 30, 2004. A final report shall be provided to the education and fiscal committees of the house of representatives and the senate by December 20, 2004.

       Expires June 30, 2005.

        Declares that the breed of a dog shall not be a determining factor when declaring a dog potentially dangerous or dangerous.

        Provides that a dog may not be considered potentially dangerous or dangerous if the dog's threatening behavior or infliction of injury or damage was sustained by a person who, at the time, was: (1) Committing a willful trespass or other tort upon the premises occupied by the owner of the dog;

        (2) Tormenting, abusing, or assaulting the dog or has, in the past, been observed or reported to have tormented, abused, or assaulted the dog; or

        (3) Committing or attempting to commit a crime.

        Declares that "dog" includes wolf-dog hybrids.

Providing an appeal process for state agency and local government permit decisions for economic development projects.

       Declares that the purpose of this act is to reform the process of appeal and review of permit decisions made by state agencies for qualifying economic development projects, by establishing uniform, expedited, and consolidated appeal procedures and uniform criteria for reviewing such decisions, in order to provide consistent, predictable, and timely judicial review. The appeal process authorized in this act is intended to be the exclusive process for review of decisions made by agencies on permit applications for qualifying economic development projects, superseding other existing administrative board appeal procedures.

Protecting the interests of recreational fishers.

       Provides that the marine waters of the state of Washington may not be permanently closed to recreational fishing unless: (1) There is a clear indication that recreational fishing is the cause of a specific conservation problem and that less severe conservation measures, including but not limited to, minimum size requirements, bag limits, or seasonal closures will not adequately provide for conservation of the affected stocks of fish;

       (2) The closed area rules include specific measurable criteria to determine the conservation benefit of the closed area on the affected stocks of fish and provide a timetable for periodic review of the continued need for the closed area at least once every three years;

       (3) The closed area is no larger than that which is supported by the best available scientific information as determined by the department; and

       (4) Provisions are made to reopen the closed area to recreational fishing whenever the basis for the closure no longer exists.

Establishing a system of standards and procedures concerning water quality data.

        Finds that: (1) Proper collection and review of credible water quality data is necessary to ensure compliance with the requirements of the federal clean water act;

        (2) Developing and implementing water quality protection measures based only on credible water quality data ensures that the financial resources of state and local governments and regulated entities are prioritized to address our state's most important water quality issues; and

        (3) The state currently lacks standards relating to the collection of water quality data even though the collection and analysis of that data provides the basis for water quality protection efforts and can have significant regulatory and financial impacts.

        Declares an intent to establish a system of standards and procedures to ensure that only credible water quality data is used as the basis for specific state water quality programs.

Modifying the authority of the Columbia river gorge commission.

(DIGEST OF PROPOSED 1ST SUBSTITUTE)

       Declares that the commission may not issue a land use decision that prohibits reasonable development of a property or parcel unless the commission compensates the owner for the loss in value due to the inability to reasonably develop the property or parcel. The loss in value shall be determined by the assessor of the county in which the property or parcel is located.

       Provides that the commission shall not serve as an adjudicatory body and may not hear any appeals of land use or building permit decisions. All such appeals within the commission's jurisdiction shall be heard by the superior court of competent jurisdiction.

Creating a program to increase undergraduate and graduate enrollment in high-demand fields and programs.

(DIGEST OF PROPOSED 1ST SUBSTITUTE)

        Creates a program to contract for undergraduate and graduate placements in high-demand fields and programs. For purposes of this program, high-demand fields and programs are programs where enrollment access is limited and fields where employers are experiencing difficulty finding enough qualified graduates to fill job openings. The higher education coordinating board shall administer the program, subject to appropriation.

        Declares that Washington public community and technical colleges, public baccalaureate institutions, and private nonprofit colleges and universities are eligible to apply for high demand enrollment funds.

        Authorizes the board to accept applications for an enrollment contract from an in-state or border-state, private nonprofit institution but only where such entities have agreed to partner with a public, Washington state college or university to deliver the educational program in high demand.

        Requires participating institutions to cooperate with the board to collect the data necessary to report to the governor and the legislature on the impact of the program in this act, particularly the degree of improved access to high-demand fields and programs for students and successful job placements for graduates.

Changing tuition provisions for institutions of higher education.

(DIGEST OF PROPOSED 1ST SUBSTITUTE)

       Finds that, as a partner in financing public higher education with students and parents who pay tuition and fees, periodic increases in state funding, state financial aid, and tuition must be authorized to provide high quality higher education for the citizens of Washington. It is the intent of the legislature to address higher education through a cooperative bipartisan effort that includes the legislative and executive branches of government, parents, students, educators, as well as business, labor, and community leaders.

       Recognizes the importance of keeping the public commitment to public higher education and will continue searching for policies that halt the trend for the growth in tuition revenue to outpace the revenue provided by the state.

       Finds that the six-year time limitation authorizing the governing boards to establish tuition rates for all students other than undergraduate resident students will give the legislature, the governor, and the higher education institutions an opportunity to determine whether this policy achieves the goal of maintaining quality and access for all who are eligible for and can benefit from a higher education. Using data from six years of this tuition policy, the state will be able to identify options for long-term funding of higher education including not only tuition but general fund and financial aid sources.

(DIGEST OF PROPOSED 1ST SUBSTITUTE)

       Finds that: (1) It is in the public interest to take steps to mitigate the effects of these changes on low-income persons; and

       (2) Advances in telecommunications technologies, such as community service voice mail provide new and economically efficient ways to secure many of the benefits of universal service to low-income persons who are not customers of local exchange telephone service.

       Authorizes a discount on a community service voice mailbox that provides recipients with: (1) An individually assigned telephone number;

       (2) The ability to record a personal greeting; and

       (3) A secure private security code to retrieve messages.

       Directs the department to enter into an agreement with the department of community, trade, and economic development for an amount not to exceed eight percent of the prior fiscal year's total revenue for the administrative and program expenses of providing community service voice mail services. The community service voice mail service may include toll-free lines in community action agencies through which recipients can access their community service voice mailboxes at no charge.

(DIGEST OF PROPOSED 1ST SUBSTITUTE)

        Declares an intent to support local initiatives that attempt to integrate social and health services, streamline and reduce administrative costs, and establish new organizational entities that provide faster, smarter, and more efficient social and health services.

        Directs the department of social and health services to consider proposals from counties or groups of counties to design a new administrative and service delivery infrastructure for supporting and managing social and health services provided by the county or group of counties. Each proposal shall be for a five-year pilot project.

        Provides that the services to be included in the pilot project may include, but are not limited to, mental health, substance abuse, and developmental disabilities.

        Directs the department of social and health services to submit proposed changes in statute and operating budget procedures to the legislature by January 15, 2004, to implement the proposals solicited under this act.

(DIGEST OF PROPOSED 1ST SUBSTITUTE)

       Creates the educational assistance grant program for students with dependents subject to the availability of receipts of gifts, grants, or endowments from private sources. The program is created to serve financially needy students with dependents eighteen years of age or younger, by assisting them directly through a grant program to pursue a degree or certificate at public or private institutions of higher education, as defined in RCW 28B.10.802, that participate in the state need grant program.

       Declares that, to be eligible for the educational assistance grant program for students with dependents, applicants shall: (1) Be residents of the state of Washington;

       (2) Be needy students as defined in RCW 28B.10.802(3);

       (3) Be eligible to participate in the state need grant program as set forth under RCW 28B.10.810; and

       (4) Have dependents eighteen years of age or younger who are under their care.

       Provides that the educational assistance grant program for students with dependents grants may be used by eligible participants to attend any public or private college or university in the state of Washington as defined in RCW 28B.10.802.

       Provides that a county or city that is required or chooses to plan under RCW 36.70A.040 may, upon written request by the property owner and following the procedures required in that chapter, amend its comprehensive plan and development regulations to allow agricultural lands that have not been in use for commercial production within the previous five years to be used for recreational activities, including fields for sports played on grass, provided that: (1) The lands are conserved for potential future agricultural use;

       (2) No permanent structures are erected on or beneath the lands; and

       (3) The county or city annually reviews this interim use and the potential productive agricultural use of the lands.

        Directs the department to use moneys from the 211 account and other legislative appropriations to finance in whole or in part the study, design, implementation, and support of a statewide 211 system.

        Declares that activities eligible for assistance from the 211 account and other legislative appropriations include, but are not limited to: (1) Creating a structure for a statewide 211 resources data base that will meet the alliance for information and referral systems standards for information and referral systems data bases and that will be integrated with local resources data bases maintained by approved 211 service providers;

        (2) Developing a statewide resources data base for the 211 system;

        (3) Maintaining public information available from state agencies, departments, and programs that provide health and human services for access by 211 service providers;

        (4) Providing grants to approved 211 service providers for the design, development, and implementation of 211 for its 211 service area;

        (5) Providing grants to approved 211 service providers to enable them to provide 211 service on an ongoing basis; and

       (6) Providing grants to approved 211 service providers to enable the provision of 211 services on a twenty-four-hour per day seven-day a week basis.

       Declares that the addition of fluoridation compounds to water provided by a group A water system as defined in RCW 70.119.020 not adding fluoridation compounds as of the effective date of this act shall be permitted only upon an affirmative vote of: (1) The water system's customers; or

       (2) The water system's elected local governing body or operator directly responsible to the department for utility operations.

        Declares that the appeal process authorized in this act is intended to be the exclusive process for review of certain decisions made by agencies on permit applications for certain qualifying projects, superseding other existing statutory appeal procedures.

        Provides that information provided to students at each state-supported college and university shall include the approximate amount of state support received by students in each tuition category at that institution. The amount of state support shall be based on the information provided by the higher education coordinating board under this act.

        Provides that, beginning with the 2003 fall academic term, information provided to students shall appear in a conspicuous location on all tuition and billing packets. Information provided under this provision shall be provided on tuition and billing packets for resident undergraduate and resident graduate students.

        Authorizes tuition and billing packets to also contain a statement informing students that they may request an itemized statement of fees charged to all students.

       Provides that, except for community and technical colleges, each degree-granting public or private postsecondary residential campus that provides on-campus or group housing shall provide information on meningococcal disease to each enrolled matriculated first-time student. Community and technical colleges must provide the information only to those students who are offered on-campus or group housing. The information about meningococcal disease shall include: (1) Symptoms, risks, especially as the risks relate to circumstances of group living arrangements, and treatment; and

       (2) Information on the vaccination that may prevent the student from contracting the disease, that students in the high-risk group consider receiving the vaccine, and where the vaccination can be received.

Providing for the registration of nursing technicians.

(DIGEST OF PROPOSED 1ST SUBSTITUTE)

       Finds a need to provide additional work-related opportunities for nursing students. Nursing students enrolled in bachelor of science programs or associate degree programs, working within the limits of their education, gain valuable judgment and knowledge through expanded work opportunities.

       Provides that nursing technicians may function only under the direct supervision of a registered nurse who agrees to act as supervisor and is immediately available to the nursing technician. The supervising registered nurse must have an unrestricted license with at least two years of clinical practice in the setting where the nursing technician works.

        Provides that nursing technicians may only perform specific nursing functions based upon and limited to their education and when they have demonstrated the ability and been verified to safely perform these functions by the nursing program in which the nurse technician is enrolled. The nursing program providing verification is immune from liability for any nursing function performed or not performed by the nursing technician.

        Declares that nursing technicians are responsible and accountable for their specific nursing functions.

        Requires the department to investigate complaints of violations of this act by an employer. Failure of an employer to comply with this act is punishable by a civil penalty not to exceed one thousand dollars per infraction. The department shall maintain records of all employers that have violated this act.

       Provides that, in accordance with RCW 34.05.350, the department of labor and industries may adopt emergency rules necessary to protect the health and safety of farmworkers.

       Provides that funding for this pilot project will be obtained from the current allocation to the occupational and environmental research facility as designated in RCW 51.16.042.

Regulating the provision of wholesale telecommunications services by public utility districts.

(DIGEST OF PROPOSED 1ST SUBSTITUTE)

        Requires a public utility district providing wholesale telecommunications services to provide, at a just and reasonable rate, nondiscriminatory access for private providers of telecommunications services to poles, conduits, or other permanent distribution facilities owned by the public utility district unless the facilities have insufficient capacity for such access and additional capacity cannot reasonably be added to the facilities or such access would violate standard industry safety and operational requirements. Except as provided in a facilities use contract between a public utility district and a private telecommunications service provider, a public utility district shall not require the removal or prohibit the replacement of telecommunications facilities owned by private telecommunications service providers from its facilities.

        Provides that, when the state auditor makes a finding that a public utility district providing wholesale telecommunications services has violated RCW 54.16.330 or this act, the district shall submit a report to the appropriate committees of the legislature within thirty days of the issue date of the finding. The report must include, at a minimum: (1) A description of all activities relating to the construction, acquisition, operation, marketing, and leasing of telecommunications facilities and wholesale telecommunications services; and

        (2) A description of the number of new locations connected to the telecommunications facilities resulting from the provision of wholesale telecommunications services to internet service providers and entities authorized to provide telecommunications services to the general public.

Regulating the sale of cigarettes.

       Declares that it is the responsibility of the person who mails, ships, or otherwise delivers cigarettes before the first delivery sale of cigarettes to: (1) Verify the age of the receiver of the cigarettes upon delivery; and

       (2) Obtain in writing verification of the receiver's address and that the receiver of the cigarettes is not a minor. The statement must also confirm if the prospective consumer understands: (a) That signing another person's name to the certification is a violation of RCW 9A.60.040 (1)(a); (b) that the sale of cigarettes to a minor is a violation of RCW 26.28.080; (c) that the purchase of cigarettes by minors is a violation of RCW 70.155.080; and (d) that he or she has the option to receive mailings from a tobacco company about tobacco products.

Providing natural resource protection in Skagit county.

(DIGEST OF PROPOSED 1ST SUBSTITUTE)

       Declares that the purposes of this act are: (1) To protect lands designated by the county as agricultural land of long-term commercial significance from the effects of saltwater intrusion and diminishment of drainage capability for drainage infrastructure, including flood gates, pump stations, ditches, and tide gates;

       (2) To require examination of opportunities to enhance tidal fish habitat on hundreds of acres of publicly owned land while maintaining habitat for migratory birds; and

       (3) To allow tide gates located on bona fide streams to proceed through a fish habitat restoration planning process to find opportunities to use fish habitat while avoiding harm to existing land uses.

       Provides that, from funds appropriated to the department of fish and wildlife for salmon restoration activities, the fish and wildlife commission and the department of fish and wildlife, in coordination with the Skagit county legislative authority and diking and drainage district commissioners, and local landlowners, shall establish the Skagit delta fish passage pilot project to jointly develop a strategy to enhance tidal fish habitat and address the management, operation, and maintenance of tide gates on streams in Skagit county while assuring no net loss of agricultural lands or their productivity. The strategy must be submitted to the appropriate standing committees of the legislature by December 1, 2004.

       Provides that, during the Skagit delta fish passage pilot project the department of fish and wildlife may not require fish passage as a condition of hydraulic project approval for maintenance, improvement, or replacement of agricultural drainage systems under chapter 77.55 RCW until July 1, 2005, after the strategy developed under this act has been submitted to the legislature.

       Provides that any condition requiring fish passage in an existing hydraulic project approval issued for a tide gate in Skagit county under chapter 77.55 RCW is stayed until July 1, 2005.

       Expires July 1, 2005.

Forming the state interoperability executive committee.

(DIGEST OF PROPOSED 1ST SUBSTITUTE)

        Declares an intent to ensure that the state's considerable investment in radio communications facilities, and the radio spectrum that is licensed to government entities in the state, are managed in a way that promotes to the maximum extent the health and safety of the state's citizens and the economic efficiencies of coordinated planning, development, management, maintenance, accountability, and performance.

        Finds that such coordination is essential for disaster preparedness, emergency management, and public safety, and that such coordination will result in more cost-effective use of state resources and improved government services.

        Requires the board to appoint a state interoperability executive committee, the membership of which shall include, but not be limited to, representatives of the military department, the Washington state patrol, the department of transportation, the department of information services, the department of natural resources, city and county governments, state and local fire chiefs, police chiefs and sheriffs, and state and local emergency management directors.

        Requires the committee to take inventory of and evaluate all state and local government-owned public safety communications systems, and prepare a statewide public safety communications plan. The plan shall set forth recommendations for executive and legislative action to insure that public safety communications systems can communicate with one another and conform to federal law and regulations governing emergency communications systems and spectrum allocation.        Finds that there is a need to remove certain administrative programs from the jurisdiction of the higher education coordinating board in order to enable the board to concentrate on its policy and planning responsibilities.

       Finds that centralizing postsecondary education administrative functions within one agency will facilitate communication, cooperation, and the efficient use of public resources.

       Declares an intent to create a student financial aid and scholarship commission to administer postsecondary education programs assigned to the commission by the governor or the legislature.

       Provides that the commission shall administer assigned educational responsibilities in cooperation and consultation with students, faculty, administrators, displaced homemakers, public and private educational institutions, the higher education coordinating board, the superintendent of public instruction, the council of presidents, the state board for community and technical colleges, and the Washington friends of higher education.

Restricting access to motor vehicles for persons arrested for alcohol offenses.

        Finds that it is imperative to ensure that people who are arrested for driving under the influence of intoxicating liquor or any drug are not released to third parties who then allow them to resume control of a motor vehicle.

        Provides that, before a law enforcement officer releases a person arrested for a violation of RCW 46.61.502 or 46.61.504 to a third person, the officer shall serve notice in writing on the third person advising the person of potential civil and criminal liability if the person facilitates or permits the arrested person released to his custody to resume operation of a motor vehicle while still intoxicated or impaired.

        Requires that, before the arrested person is released to a third person, receipt of the notice must be acknowledged in writing by the third person.

        Provides that, if the third person refuses to sign the acknowledgment, the person arrested for a violation of RCW 46.61.502 or 46.61.504 shall remain in custody.
