by House Committee on Finance (originally sponsored by Representatives Berkey, Pearson, Morris, Kristiansen, Sullivan, Buck, Dunshee, Cooper, Lovick, Sehlin, Bailey, Kessler and Nixon)
Revising business and occupation taxation for certain aviation businesses.
(DIGEST OF PROPOSED 1ST SUBSTITUTE)
Provides that, upon every person engaging within this state in the business of making sales at retail that are exempt from the tax imposed under chapter 82.08 RCW by reason of RCW 82.08.0261, 82.08.0262, or 82.08.0263, that are classified by the federal aviation administration as FAR part 145 certificated repair stations with an airframe class 4 rating and limited capabilities in instruments, radio equipment, and specialized services, as to such persons, the amount of tax with respect to such business shall be equal to the gross proceeds of sales of the business, multiplied by the rate of .275 percent.
Requires a person reporting tax under RCW 82.04.250(3) to file a report to the department of revenue in the month following each calendar quarter containing the following information: (1) Number of production workers;
(2) Average wage of production workers;
(3) Total wages for production workers;
(4) Total sales as measured by taxable receipts for activities reported under RCW 82.04.250(3); and
(5) Total wages for production workers as a percent of total sales reported under RCW 82.04.250(3).
Declares that a recipient who fails to submit a complete report under this act is ineligible on a prospective basis for the rate provided in RCW 82.04.250(3).
Expires July 1, 2006.

Modifying tobacco escrow refund provisions.
(DIGEST OF PROPOSED 1ST SUBSTITUTE)
Revises tobacco escrow refund provisions.
Declares that, if this act is held by a court of competent jurisdiction to be unconstitutional, then RCW 70.157.020(b)(2)(B) shall be repealed in its entirety. If RCW 70.157.020(b)(2)(B) shall thereafter be held by a court of competent jurisdiction to be unconstitutional, then this act shall be repealed, and RCW 70.157.020(b)(2)(B) be restored as if no amendments had been made. Neither any holding of unconstitutionality nor the repeal of RCW 70.157.020(b)(2)(B) shall affect, impair, or invalidate any other portion of RCW 70.157.020 or the application of that section to any other person or circumstance, and the remaining portions of RCW 70.157.020 shall at all times continue in full force and effect.

Establishing a quality maintenance fee on nursing facilities.
(DIGEST OF PROPOSED 2ND SUBSTITUTE)
Provides that, in addition to any other tax, a quality maintenance fee is imposed on every nonexempt nursing facility in this state. The quality maintenance fee is six dollars and fifty cents per patient day.
Requires each operator of a nonexempt nursing facility to file a return with the department on a quarterly basis. The return is due within thirty days after the end of each calendar quarter. The return shall include the following: (1) The number of patient days for nonexempt nursing facilities operated by that person in that quarter; and
(2) Remittance of the nonexempt nursing facility operator's quality maintenance fee for that quarter.
Declares that all of chapter 82.32 RCW, except RCW 82.32.045 and 82.32.270, applies to the fee imposed by this act, in addition to any other provisions of law for the payment and enforcement of the fee imposed by this act.
Finds that payment of the quality maintenance fee imposed by this act may cause an undue financial hardship to operators of certain nursing facilities, and intends to exempt such facilities from the fee to the extent permissible under the federal medicaid program.

Modifying the distribution of state property taxes.
(DIGEST OF PROPOSED 1ST SUBSTITUTE)
Provides that: (1) Out of taxes collected in calendar year 2004, an annual amount equal to two hundred fifty-four dollars per full-time equivalent student in all school districts shall be deposited in the student achievement fund to be distributed to each school district based on two hundred fifty-four dollars per full-time equivalent student for school year 2004-2005.
(2) Out of taxes collected in calendar year 2005, an annual amount equal to three hundred dollars per full-time equivalent student in all school districts shall be deposited in the student achievement fund to be distributed to each school district based on three hundred dollars per full-time equivalent student for school year 2005-2006.
(3) Out of taxes collected in calendar year 2006, an annual amount equal to three hundred seventy-five dollars per full-time equivalent student in all school districts shall be deposited in the student achievement fund to be distributed to each school district based on three hundred seventy-five dollars per full-time equivalent student for school year 2006-2007.
(4) Out of taxes collected in calendar year 2007, an annual amount equal to four hundred fifty dollars per full-time equivalent student in all school districts shall be deposited in the student achievement fund to be distributed to each school district based on four hundred fifty dollars per full-time equivalent student for school year 2007-2008. Each subsequent year following the 2007-2008 school year, the amount deposited and distributed shall be adjusted for inflation as defined in RCW 43.135.025 (8).
