Using education funds.
Creates the student achievement fund in the state treasury. Appropriations from the student achievement fund may be made for the following purposes: (1) Distributions to school districts on a per pupil basis for the purposes set forth in RCW 28A.505.210. (a) For the 2003-04 school year, moneys in the student achievement fund shall be distributed on the basis of an equal amount per full-time equivalent student as provided in RCW 84.52.068 and 43.135.045(5). (b) Beginning with school year 2004-05, the legislature shall appropriate an annual amount equal to three hundred sixteen dollars per full-time equivalent student to the superintendent of public instruction for distribution to each school district based on three hundred fifteen dollars per full-time equivalent student for each school year.
(2) Beginning with school year 2004-05, allocations to school districts for the better schools program, subject to any conditions, limitations, and formulae in the omnibus operating appropriations act.
(3) Beginning with school year 2004-05, appropriations to the higher education coordinating board and two-year and four-year institutions of higher education for programs that increase access to higher education, including but not limited to the Washington promise scholarship program and high-demand enrollments, and subject to any conditions or limitations in the omnibus operating appropriations act.
(4) The legislature, in the omnibus operating appropriations act, may transfer unappropriated balances in the student achievement fund to the general fund.
Provides that, after July 1, 2004, the legislature may direct the transfer of lottery deposits from the education construction fund to the state general fund in the omnibus operating appropriations act.

Requires the department to collect a two-dollar surcharge on the purchase of: (1) All resident and nonresident shellfish and seaweed licenses issued under RCW 77.32.520(2)(a); and
(2) All resident and nonresident adult combination licenses issued under RCW 77.32.470(2)(a).
Provides that the surcharge collected under this act must be deposited in the general fund--local account managed by the department of health, and used by the department of health to fund biotoxin testing and monitoring on beaches used for recreational shellfishing.
Provides that any amounts collected under this act that are in excess of the annual cost of the recreational shellfish testing and monitoring program shall be transferred by the department of health to the general fund.

Concerning the treatment of income and resources for institutionalized persons receiving medical assistance.
Provides that, for persons institutionalized on or after July 1, 2003, the department, in the interest of supporting the community spouse, shall allow up to a maximum of thirty thousand dollars in resources for the community spouse. For the fiscal biennium beginning July 1, 2005, and each fiscal biennium thereafter, the maximum resource allowance amount for the community spouse shall be adjusted for economic trends and conditions by increasing the amount allowable by the consumer price index as published by the federal bureau of labor statistics. However, in no case shall the amount allowable exceed the maximum resource allowance permissible under the social security act.

Concerning services for persons with developmental disabilities.
Recognizes that the primary resource for long-term support continues to be family. However, family caregivers are increasingly employed outside the home. In addition, many families continue to support their sons and daughters when they are no longer legally obligated to do so.
Finds that supporting caregivers in a collaborative fashion can keep families together, prevent out-of-home placements, and leverage public and private support for people with a developmental disability.
Finds the delivery of services to persons with developmental disabilities should be prioritized based upon an individual needs assessment. Limited state resources should be allocated in a manner that complements and supports the use of individual family and natural supports, enabling the individual to be independent and not reliant upon institutional or residential care services until such time as these services are required in order to reasonably assure the health and safety of the individual.
Declares an intent that the provisions of this act shall be applied to individuals currently and prospectively receiving services under Title 71A RCW. The immediate implementation of this act is necessary for the support of state government and its institutions and programs.

Revises the expiration date on the research and development business and occupation tax credit.
Directs the joint legislative audit and review committee to provide a report to the legislature the year before and every five years after the renewal of the tax credit in RCW 82.04.4452. The report shall be based upon information provided by the employment security department and the department of revenue. Proprietary information shall remain confidential as otherwise provided by law. The report shall include, but is not limited to: (1) Total value of tax revenue forgone as a result of the tax credit;
(2) Total value of qualifying investments made under the tax credit;
(3) Direct employment created or retained that is associated with the tax credit and average wages, reported in aggregate by North American industry classification;
(4) Total indirect employment created or retained associated with the tax deferral;
(5) Additional sales, property, and business and occupation tax revenues associated with the tax credit.
Provides that, in conducting this evaluation, the joint legislative audit and review committee shall use a generally accepted economic model and may contract with outside economic experts.

Enhancing patient safety and medical error reduction efforts.
Requires the secretary to increase the licensing fee established under RCW 43.70.110 for health care professionals and facilities designated in this act by one percent of the amount of the applicable annual licensing fee. Proceeds of the patient safety fee must be dedicated to patient safety and medical error reduction efforts that have been proven to improve the quality of care provided by health care professionals and facilities.
Declares that health care professionals and facilities subject to the one percent patient safety fee include: (1) Health care professionals licensed under Title 18 RCW; and
(2) Hospitals licensed under chapter 70.41 RCW, psychiatric hospitals licensed under chapter 71.12 RCW, and ambulatory diagnostic, treatment, or surgical facilities licensed under chapter 70.41 RCW.
Provides that one percent of the present value of the settlement or verdict in any action for damages based upon injuries resulting from health care shall be deducted from the settlement or verdict as a patient safety fee. Proceeds of the patient safety fee will be distributed by the department of health in the form of grants, loans, or other appropriate arrangements to support strategies that have been proven to reduce medical errors and enhance patient safety.
Authorizes the secretary to solicit and accept grants or other funds from public and private sources to support patient safety and medical error reduction efforts under RCW 43.70.110 and 43.70.250 and sections 3 and 4 of this act. Any grants or funds received may be used to enhance these activities as long as program standards established by the secretary are maintained.
