Enhancing government accountability.

Finds that: (1) Public confidence in government is essential. Public programs must continuously improve in quality, efficiency, and effectiveness in order to increase public trust;
(2) Washington state government and other entities that receive tax dollars must continuously improve the way they operate and deliver services so citizens receive maximum value for their tax dollars;
(3) An independent citizen oversight board is necessary to establish a program to ensure that government services, customer satisfaction, program efficiency, and management systems are world class in performance; and
(4) Fair, independent, professional performance audits of state agencies by the state auditor are essential to improving the efficiency and effectiveness of government.
Creates the citizen oversight board to improve efficiency, effectiveness, and accountability in state government.
Provides that the board and the state auditor shall work together regarding performance audits of state government.
Directs the board to establish criteria for performance audits. Agencies shall be audited using criteria that include generally accepted government auditing standards as well as legislative mandates and performance objectives established by state agencies. Mandates include, but are not limited to, agency strategies, time lines, program objectives, and mission and goals as required in RCW 43.88.090.
Authorizes the state auditor and the board to develop a grading system for the audits. The audit report may include the agency grade, evaluation and identification of best practices, and findings and recommendations for efficiency and effectiveness of state programs. The board and the state auditor shall examine a system for grading the audits. The board shall report its findings to the legislature by December 31, 2003.
Requires the state auditor to solicit comments on preliminary performance audit reports from the audited state agency, the office of the governor, the office of financial management, the board, and the joint legislative audit and review committee for comment.
Requires the final reports to be submitted to the board by the state auditor. The board and the state auditor shall jointly release final reports to the citizens of Washington, the governor, and the appropriate legislative committees. Final performance audit reports shall be posted on the internet.
Provides that the audited agency is responsible for follow-up and corrective action on all performance audit findings and recommendations. The audited agency's plan for addressing each audit finding and recommendation shall be included in the final audit report.
Provides that the citizen oversight board created in this act and its powers and duties shall be terminated June 30, 2010.
Appropriates the sum of one hundred ninety-two thousand dollars, or as much thereof as may be necessary, for the fiscal year ending June 30, 2004, from the general fund to the state auditor for the purposes of this act.
Appropriates the sum of seven hundred sixty-eight thousand dollars, or as much thereof as may be necessary, for the fiscal year ending June 30, 2005, from the general fund to the state auditor for the purposes of this act.
Appropriates the sum of forty thousand dollars, or as much thereof as may be necessary, for the fiscal year ending June 30, 2005, from the general fund to the joint legislative audit and review committee for the purposes of this act.

Providing tax incentives for the retention and expansion of the aerospace industry in Washington state.
Finds that the people of the state have benefited from the presence of the aerospace industry in Washington state. The aerospace industry provides good wages and benefits for the thousands of engineers, mechanics, and support staff working directly in the industry throughout the state. The suppliers and vendors that support the aerospace industry in turn provide a range of jobs.
Declares that it is in the public interest to encourage the continued presence of this industry through the provision of tax incentives. The comprehensive tax incentives in this act address the cost of doing business in Washington state compared to locations in other states.
Provides that chapter . . ., Laws of 2003 1st sp. sess. (this act) takes effect on the first day of the month in which the governor and a manufacturer of commercial airplanes sign a memorandum of agreement regarding an affirmative final decision to site a significant commercial airplane final assembly facility in Washington state. The department shall provide notice of the effective date of chapter . . ., Laws of 2003 1st sp. sess. (this act) to affected taxpayers, the legislature, and others as deemed appropriate by the department.
Provides that chapter . . ., Laws of 2003 1st sp. sess. (this act) is contingent upon the siting of a significant commercial airplane final assembly facility in the state of Washington. If a memorandum of agreement under subsection (1) of this section is not signed by June 30, 2005, chapter . . ., Laws of 2003 1st sp. sess. (this act) is null and void.
Directs the department to make a determination regarding the date final assembly of a superefficient airplane begins in Washington state. The rates in RCW 82.04.260(13)(a)(ii) and (b)(ii) take effect the first day of the month such assembly begins, or July 1, 2007, whichever is later. The department shall provide notice of the effective date of such rates to affected taxpayers, the legislature, and others as deemed appropriate by the department.
Provides that, if on December 31, 2007, final assembly of a superefficient airplane has not begun in Washington state, the department shall provide notice of such to affected taxpayers, the legislature, and others as deemed appropriate by the department.

Authorizing charter schools.
Declares an intent to authorize the establishment of public charter schools within the general and uniform system of public schools for the primary purpose of providing more, high quality learning environments to assist educationally disadvantaged students and other students in meeting the state's academic standards.
Declares an intent for charter schools to function as an integral element of the public school system maintained at public expense, free from discrimination, and open to all students in the state, and to be subject to the same academic standards and performance outcomes as other public schools.
Intends to encourage school districts to consider using the chartering process as an optional tool for achieving state and federal accountability goals.
Finds that in addition to providing more, high quality public school choices for families, teachers, and students, public charter schools may be a tool for the improvement of schools in which significant numbers of students persistently fail to meet state standards.
Intends to authorize the use of the chartering process as a state intervention strategy, consistent with the provisions of the federal no child left behind act of 2001, to provide assistance to schools in which significant numbers of students persistently fail to meet state standards.
Provides that a charter school shall operate independently of any school district board, under a charter approved by a sponsor or an alternate sponsor under this act.
Provides that charter schools are exempt from all state statutes and rules applicable to school districts and school district boards of directors except those statutes and rules as provided for and made applicable to charter schools in accordance with this act and in the school's approved charter.
Provides that, to effectuate the primary purpose for which the legislature established charter schools, a charter school must be willing to enroll educationally disadvantaged students and may not limit admission on any basis other than age group and grade level. Consistent with the legislative intent of this act, a charter school shall conduct timely outreach and marketing efforts to educationally disadvantaged students in the school district in which the charter school will be located.

Provides for charter renewal and revocation.
Provides that, subject to funding, the Washington institute for public policy shall study the implementation and effectiveness of this act. The institute shall report to the legislature on the effectiveness of charter schools in raising student achievement and the impact of charter schools. The institute also shall examine and discuss whether and how charter schools have enhanced education reform efforts and recommend whether relaxing or eliminating certain regulatory requirements for other public schools could result in improved school performance at those schools. The institute shall recommend changes to this act including improvements that could be made to the application and approval process. A preliminary report of the study is due to the legislature by March 1, 2006, and a final report is due September 1, 2007.
Provides for the maximum number of charter schools.
