Revising provisions relating to guardianship of dependent children.
Finds that guardianship for some children who have been found to be dependent children under chapter 13.34 RCW and who cannot live with their parents is a valuable resource for such children needing stability in their lives when such placement is in the best interests of the child.
Declares an intent to enhance family preservation and stability for children by recognizing the value of permanent placement with relatives or other long-term caregivers, dismissal of dependencies, and elimination of the need for continued governmental intervention in family life.
Declares an intent to expand opportunities for children to remain with relatives or long-term caregivers when they can no longer live with their parents through provision of support to relatives and unrelated persons who are willing and able to serve as guardians for the children.

Declares that, as used in this act, "containment room" means a room, space, or facility, other than a school principal's office, separate and apart from the classroom where the student receives the majority of daily instruction, in which the student is isolated from the rest of the school population for the purpose of student discipline or behavioral intervention.
Provides that, by September 1, 2004, within existing resources, the board of directors of each school district, if a containment room is used in any school facility in the district, shall adopt a policy regarding the use of such rooms. The policy required under this act shall be provided to parents annually.

Requires the secretary to adopt rules prescribing standards and criteria to assure that each Washington state ferry system contract entered into with a private party or firm for vessel galley services must contain specific clauses requiring the following: (1) The contractor must provide for persons performing the services under the contract health benefits that are similar to those provided to Washington state ferry system employees, but in no case are such health benefits required to be greater than the benefits provided for basic health care services under chapter 70.47 RCW.
(2) The contractor must provide for persons performing the services under the contract pension benefits that are similar to those provided to Washington state ferry system employees, but in no case are pension benefits required to be greater than the terms, benefits, and allowances under chapter 41.40 RCW.

Requires the department to reestablish, maintain, and operate or contract to operate galley food service on vessels within the existing and future fleet. In providing galley service, the department shall adhere to the following: (1) Vessels currently configured for full galley service must be maintained to provide on-going future full galley service;
(2) On routes where galley service was operated during calendar year 2003, the department shall restore galley staffing to the December 2003 actual levels, at a minimum; and
(3) Any seasonal adjustments to galley service must be based on historical practices and service levels provided.

Creating a center for advanced manufacturing.
Declares that, although manufacturing has long been subject to the ups and downs of regular market cycles, the increasing pace of globalization and the ability of the world's new manufacturing floor to export deflation has caused United States manufacturers to lose all pricing power. Despite the development of good cost control practices such as lean manufacturing, domestic manufacturers cannot compete on price alone.
Declares that, as our economy continues to evolve through changes to our existing manufacturing base, our manufacturers need assistance to continue to provide high quality products at a low cost. In order to make a radical change to an innovation focus, there must be a public and private partnership.

Provides that the equipment and standards review unit shall require a record check of all applicants and drivers for an authorized emergency vehicle permit through the Washington state patrol criminal identification section pursuant to RCW 10.97.050 and through the federal bureau of investigation before issuing an authorized emergency vehicle permit. The record check shall include a fingerprint check using a complete Washington state criminal identification fingerprint card.

Provides that, if the person's test or tests indicated that the person's breath or blood concentration was less than 0.15 and the person has had his or her license suspended, revoked, or denied due to a criminal conviction under RCW 46.61.5055 arising out of the same incident, the department shall give the person credit for the number of days the person's license has already been suspended, revoked, or denied.
Provides that, if a person has had his or her license suspended, revoked, or denied due to an administrative action under RCW 46.20.3101(2) arising out of the same incident, the department shall give the person credit for the number of days the person's license has already been suspended, revoked, or denied if the person submitted to or has been administered a test or tests indicating that the person's breath or blood concentration was less than 0.15 and the person has not had a previous incident within seven years that resulted in administrative action under RCW 46.20.3101.

Declares that "residence for voting purposes" means either the place at which an applicant for voter registration resides or the primary place of business of an applicant, if that applicant's residence is within the same county as the business. In order to provide the address of a primary place of business as the address of a residence for voting purposes, at least a majority of the business must be owned by the applicant.
Requires that, if the applicant is providing the address of a primary place of business as the applicant's residence for voting purposes, the applicant shall also provide the address of the applicant's home residence.

Exempting from public disclosure certain records filed with the utilities and transportation commission.
Provides that, if a request for access to records that contain valuable commercial information is received by the commission, the owner of the information must be notified of the request. Within ten business days of receipt of the notice, the owner of the information shall provide a written statement of the continuing need for confidentiality, which shall be provided to the requester.

Requires the department to establish a desirable miles-per-hour operating standard for all lanes of the highway facility.
Requires the department to report annually to the transportation commission and the legislature on the policies, operations, and effectiveness of high-occupancy toll lanes. The report must analyze and address the impacts on freeway efficiency, effectiveness for transit, ability to finance transportation services or improvements through tolls, and the impacts on all highway users.
Declares that revenues generated from toll charges on high-occupancy toll lanes may be used only for transportation services within, or directly connecting to, that transportation corridor that maximizes movement of people. All revenues derived from toll charges must be deposited into a special account within the multimodal transportation fund and used only for purposes authorized in this act.

Such a petition must be filed within six months of the alleged interference, restraint, or coercion.
Provides that, upon receiving a petition under this act, the chair of the commission shall request the appointment of an administrative law judge under Title 34 RCW to hear the petition in accordance with chapter 34.05 RCW, and shall cause to be issued and served in the name of the commission a written notice, together with a copy of the petition, requiring the respondent to appear at a hearing before the administrative law judge, at a time and place to be specified in the notice.
Directs the administrative law judge, within thirty days after the conclusion of the hearing, to issue and file with the commission findings of fact determining whether the petitioner's rights have been interfered with, restrained, or coerced. The commission shall cause the findings to be served to the petitioner and respondent in an order in the name of the commission.

Provides that a person may not operate motor driven boats and vessels under mechanical power of ten horsepower or more unless the person: (1) Is at least sixteen years of age; and
(2) Has in his or her possession a boater education card or a certificate of accomplishment; or
(3) Is accompanied by and is under the direct supervision of a person sixteen years of age or older who is in possession of a boater education card or certificate of accomplishment, or who is exempt from carrying a boater education card.

Requires the director to adopt rules establishing preassignment or postassignment or on-the-job training and testing requirements. Eight hours of preassignment training is required, and shall include a minimum of four hours of classroom instruction and four hours of either classroom or on-the-job training, or both. A department certified trainer must report the preassignment training to the department. The director may establish, by rule, training requirements for private security guards.
Provides that postassignment or on-the-job training must include a minimum of eight hours of training, of which four hours must be completed within six months from the date a private security guard license is issued by the director and four hours completed within twelve months from the date a private security guard license is issued by the department.
Provides that postassignment or on-the-job training must be in the topic areas established by the director and may occur either in a classroom setting or in the field, or both. A department certified trainer need not report postassignment or on-the-job training. However, a department-certified trainer must attest in writing that the training occurred. The number of postassignment training hours must be increased by one hour on January 1st of every year until January 1, 2011.
Provides that the director shall require companies to maintain records regarding the postassignment training hours completed by each employee. All such records are subject to inspection by the department. The training requirements and test results must be recorded and attested to as appropriate by a certified trainer.
Gives the director the authority to negotiate reciprocity agreements with other states allowing licensed security officers from Washington to work in those other states.

One of the drivers increasing the cost of liability insurance is the potential liability beyond one's proportionate share of fault that a defendant must be insured against.
Declares an intent to enact reforms that create a more equitable distribution of liability based upon one's proportionate share of fault.
Finds, notwithstanding the tort reform measures it has enacted in the past, that in many instances defendants continue to pay more than their proportionate share of a claimant's total damages. The legislature in the 1986 tort reform act adopted as the policy of this state that several, or proportionate, liability is the general rule, subject to certain limited exceptions.
Finds that this policy has been consistently recognized by the Washington state supreme court and most recently in Tegman v. Accident & Medical Investigations, 75 P.3d 497 (2003) when the court correctly stated "As we have consistently recognized, RCW 4.22.070 provides that several, or proportionate, liability is now intended to be the general rule." Tegman, 75 P.3d 499 (2003).
Declares an intent to limit further the exceptions to the general rule of several or proportionate liability.

Declares an intent to enhance family preservation and stability for children by recognizing the value of permanent placement with relatives or other long-term caregivers, dismissal of dependencies, and elimination of the need for continued governmental intervention in family life.
Declares an intent to expand opportunities for children to remain with relatives or long-term caregivers when they can no longer live with their parents through provision of support to relatives and unrelated persons who are willing and able to serve as guardians for the children.

Requires that, consistent with the essential academic learning requirements for health and fitness, including nutrition, the Washington state school directors association, with the assistance of the office of the superintendent of public instruction, the department of health, and the board of health, shall convene an advisory committee to develop a model policy regarding access to nutritious foods, opportunities for developmentally appropriate exercise, and accurate information related to these topics.
Requires the policy to address the nutritional content of foods and beverages, including fluoridated bottled water, sold or provided throughout the school day or sold in competition with the federal school breakfast and lunch program and the availability and quality of health, nutrition, and physical education curricula.
Directs the school directors association to submit the model policy and recommendations on the related issues, along with a recommendation for local adoption to the governor and the legislature, and shall post the model policy on its web site by January 1, 2005.

(2) Earned at least seventy-five percent of his or her total base year wages from employment in the fishing and seafood product preparation and packaging industries; and
(3) Has total base year wages from employment in the fishing and seafood product preparation and packaging industries that are more than 1.4 times the average annual wage.
Provides that individuals who are separated from employment between two customary work periods if they were employed during the first period and have reasonable assurance of returning to work during the second period, are not eligible for benefits during this nonwork period. However, if the individual is not offered comparable employment with the same employer in the second customary work period, they are eligible for benefits beginning the first day of the second period.

(4) Is covered by a health insurance plan providing the operator with at least ten thousand dollars in medical benefits for injuries incurred as a result of an accident while operating or riding on a motorcycle; or
(5) Has successfully completed a motorcycle skills education program under chapter 46.81A RCW.
