On page 2, beginning on line 6, strike all of subsections (3)
through (5) and insert the following:
"(3) For the purposes of this chapter, "best available science"
means a body of scientific knowledge or a collection of studies which
will provide reasonable certainty to a city or county regarding the
ecological impacts of a potential planning decision. The term does not
include knowledge or studies in ecological settings that are dissimilar
to the ecology of the jurisdiction, area, or subarea subject to the
planning decision. Decisions relating to the suitability of any
particular study, body of knowledge, or governmental agency publication
shall be made by the city or county legislative authority."
EFFECT: Provides a definition for best available science to include a body of scientific knowledge or a collection of studies which will provide reasonable certainty to a city or county regarding the ecological impacts of a potential planning decision. The term does not include knowledge or studies in ecological settings that are dissimilar to the ecology of the jurisdiction, area, or subarea subject to the planning decision. Decisions relating to the suitability of any particular study, body of knowledge, or governmental agency publication shall be made by the city or county legislative authority.
