   On page 19, after line 27, insert the following:

   "NEW SECTION. Sec. 16. A new section is added to chapter 50.12 RCW to read as follows:

   If an employer or agent of an employer files an application under a federal agricultural guest worker program, including but not limited to the federal H-2A visa program, and a request for local workers in connection with the application, the employment security department shall take the steps necessary to screen the workers to ensure that the workers referred to the employer or the agent of the employer have the legal right to work in the state."

   Renumber the remaining sections consecutively and correct internal references accordingly.

   Correct the title.

EFFECT: Requires the Employment Security Department, when responding to requests for workers in connection with federal H-2A visa program applications, to ensure that workers referred to employers and agents of employers have the legal right to work in the state.
