   On page 3, beginning on line 5, after "where the" strike "local health officer, or the department in consultation with the health officer," and insert "county legislative authority"

   On page 5, line 9, after "they are" strike "functioning properly" and insert "not failing"

   On page 5, after line 10, insert the following:

   "(3) If a repair is required under subsection (2) of this section, nothing in this section requires a homeowner to install or modify an existing on-site septic system specifically to remove nitrogen."

EFFECT: Removes the authority for the Department of Health or the local health officer to establish a marine recovery area and authorizes county legislative authorities to establish them. Specifies that within a marine recovery area the local health officer must find unknown systems and ensure they are not failing, rather than ensure they are functioning properly. Specifies that repairs to failing and unknown systems would not require a homeowner to modify an existing system to remove nitrogen.
