On page 5, after line 34, insert the following:
"NEW SECTION. Sec. 6. A new section is added to chapter 19.112 RCW to read as follows:
(1) Special fuel licensees under chapter 82.38 RCW, other than international fuel tax agreement licensees, dyed special fuel users, and special fuel distributors, shall not use biodiesel fuel derived from palm oil to qualify towards the biodiesel fuel requirements established in RCW 19.112.110, unless one of the following two conditions is satisfied:
(a) The special fuel licensee can demonstrate that, at the time of production, there was not sufficient domestic feedstock available to produce the biodiesel from canola, rapeseed, or mustard oil; or
(b) The palm oil was imported from a country in which there is verifiable environmental mitigation being conducted to offset the harvesting of palm oil, such as rainforest offsets or other efforts to achieve environmental sustainability.
(2) For purposes of this section, "palm oil" means a form of edible vegetable oil obtained from the fruit of the oil palm tree."
Correct the title.
EFFECT: Prohibits the use of biodiesel fuel derived from palm oil in satisfying the biodiesel fuel requirement established in RCW 19.112.110, unless: (1) there is not sufficient domestic feedstock available to produce the biodiesel from other sources; or (2) the palm oil used in making the biodiesel was imported from a country in which environmental mitigation is being conducted to offset the harvesting of palm oil.
