   On page 2, beginning on line 7, strike all of subsection (b) and insert the following:

   "(b) The exclusive bargaining representative of adult family home providers in the unit specified in (a) of this subsection shall be the organization certified by the commission as the sole representative after the commission conducts a secret ballot election. Before an election is conducted, an organization seeking certification as the exclusive bargaining representative of providers in the unit must make a confidential showing to the commission of credible evidence demonstrating that a majority of the providers in the unit are in support of the petition. The organization certified as the exclusive bargaining representative must receive votes from at least seventy percent of the providers in the unit in the secret ballot election." 

EFFECT: Requires that a secret ballot election, instead of a cross-check of bargaining authorization cards, be used to determine the exclusive bargaining representative. Requires a showing of interest from a majority of the providers in the bargaining unit to trigger the election, and a favorable vote from at least seventy percent of the providers in the unit to certify the organization as the exclusive bargaining representative.
