   On page 12, beginning on line 3, after "representative." strike the remainder of subsection (5) and insert the following:

   "If payment of a representation fee is contrary to bona fide personally held religious beliefs or to the tenets or teachings of a church or religious body, the child care center shall pay directly to any nonreligious charitable organization an amount of money equivalent to the representation fee. The charitable organization shall be registered with the secretary of state or recognized under Title 26 U.S.C. Sec. 501(c)(3) of the federal internal revenue code."

EFFECT: Modifies the provision allowing child care centers operated by churches or religious bodies to pay amounts equivalent to the representation fee to charitable organizations.

Requires that the representation fee be contrary to personally held religious belief or to the tenets or teachings of a church or religious body (rather than that the child care center be operated by a church or religious body).

Requires that the payment be made directly to the charitable organization.

Requires that the charitable organization be registered with the Secretary of State or be an 501(c)(3) organization (rather than one that is mutually agreed upon by the child care center and the exclusive representative, or in the absence of such agreement, by the Public Employment Relations Commission).
