   On page 18, after line 18, insert the following:

   "(c) (i) Notwithstanding any other provisions of this section, an offender may not receive any amount of earned release unless the victim consents to the earned release. If the victim is deceased or incompetent, the consent of a family member must be obtained before any earned release may be granted.

   (ii) For the purposes of this section, "Family member" means a relative by blood, marriage, or adoption, or a foster parent."

   Reletter the subsection consecutively and correct the internal references accordingly.

EFFECT: Requires that before an offender may be granted any amount of earned release the victim must consent to the earned release. If the victim is deceased or incompetent, a family member must provide the consent.
