On page 24, after line 34, insert the following:
"(ii)(A) In the case of an offender convicted of a sex offense that
is a class A felony committed on or after the effective date of this
act while the offender was participating in an individual reentry plan
established under section 203 of this act and while the offender was on
community custody or community placement, the aggregate earned release
time may not exceed five percent of the sentence.
(B) In the case of an offender convicted of a sex offense that is
a class B or C felony committed on or after the effective date of this
act while the offender was participating in an individual reentry plan
established under section 203 of this act and while the offender was on
community custody or community placement, the aggregate earned release
time may not exceed ten percent of the sentence."
EFFECT: For an offender who commits a class A felony sex offense on or after the effective date of the act while participating in an IRP and while on community custody or community placement, reduces the amount of earned release to 5% (from 10%) of his or her sentence. For an offender who commits a class B or C felony sex offense on or after the effective date of the act while participating in an IRP and while on community custody or community placement, reduces the amount of earned release to 10% (from 33%) of his or her sentence.
