   On page 2, line 33, after "public safety." insert "Money distributed from the account shall not supplant existing funds used for these purposes. For purposes of this subsection, existing funds means the actual operating expenditures for the calendar year prior to the first distribution from the account. Actual operating expenditures excludes lost federal funds, lost or expired state grants or loans, extraordinary events not likely to reoccur, change in contract provisions beyond the control of the jurisdiction receiving the services, and major capital expenditures."

EFFECT: Requires that public safety enhancement account moneys distributed to jurisdictions employing members of the Law Enforcement Officers' and Fire Fighters' Retirement System Plan 2 not supplant existing funds used for the same purposes, using actual operating expenses from the prior year excluding specified items including lost federal funds and grants.
