On page 17, beginning on line 23 of the striking amendment, after "Sec. 16." strike all material through "dealing." on p. 18, line 11 of the striking amendment, and insert the following:
"(1) The department of community, trade, and economic development shall conduct a study of the role of land use approval organizations in the regulation of residential real property and enforcement of restrictive covenants related to residential real property subject to chapter 64.38 RCW.
(2) "Land use approval organization" means any legal entity that asserts itself as a successor or assignee of the declarant or grantor, whether or not the entity meets the definition of an association under this chapter, and asserts the authority to:
(a) Enforce covenants;
(b) Approve construction of structures on residential real property;
(c) Regulate the use of such residential real property; or
(d) Grant or deny variances from any requirements pertaining to such residential real property."
EFFECT: Replaces substantive provisions related to land use approval organizations with a study of land use approval organizations to be conducted by CTED.
