   On page 3, after line 23, insert the following:

   "(7) By September 1, 2008, the department shall request an opinion from the attorney general as to whether subsection (3) of this section constitutes an unconstitutional delegation of legislative authority in violation of Article II, section 1 of the state constitution."

EFFECT: The department of revenue is directed to request an Attorney General's Opinion as to whether linking the amount of a state remittance to a federal law (and future amendments thereof) is an unconstitutional delegation of legislative authority.
