Majority Report: Do pass.Signed by Senators Hargrove, Chair; Regala, Vice Chair; Stevens, Ranking Minority Member; Brandland, Carrell, Marr and McAuliffe.

Background: SSB 5533 from the 2007 session repealed RCW 10.77.090, relating to competency restoration and civil commitment following dismissal of a criminal case, and replaced it with three new code sections. Several other statutes that point to the former RCW 10.77.090 now contain incorrect cross-references. SSB 5533 also changed the eligibility criteria for competency restoration treatment in nonfelony cases, rendering certain definitions and other sections in chapter 10.77 RCW obsolete.
Summary of Bill: This legislation corrects cross references to chapter 10.77 RCW and removes
obsolete references to portions of code that have been repealed.
Appropriation: None.
Fiscal Note: Not requested.
Committee/Commission/Task Force Created: No.
Effective Date: The bill contains an emergency clause and takes effect immediately.
Staff Summary of Public Testimony: None.
Persons Testifying: No one.
House Amendment(s): Sections repealing definitions of the terms "violent act" and "history of one or more violent acts," and presumptions relating to these definitions, are removed.
