     AN ACT Relating to the effect of extension of sewer services in aquatic rehabilitation zone one; and adding a new section to chapter 36.70A RCW.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

NEW SECTION.  Sec. 1   A new section is added to chapter 36.70A RCW to read as follows:
     (1) In aquatic rehabilitation zone one established in RCW 90.88.010, the development of one or more systems of sewerage as defined in RCW 35.67.010 and 36.94.010 or the extension of an existing system of sewerage to serve areas outside a designated urban growth area is permitted when such a development or extension serves:
     (a) A marine recovery area created in accordance with chapter 70.118A RCW;
     (b) A shellfish protection district created in accordance with chapter 90.72 RCW; or
     (c) A defined geographic area determined by the secretary of health under RCW 43.70.170 to be a threat to the public health.
     (2) When a system of sewerage is developed or expanded under subsection (1) of this section, it must comply with the intent of RCW 36.70A.110(4) by limiting its service capacity to that which will accommodate only parcels of record on the date the pertinent marine recovery area, shellfish protection district, or public health threat area was created.
     (3) For purposes of this chapter, the development or extension of a system of sewerage outside an existing urban growth area does not provide a basis for designation of that area as urban, nor does it provide a basis for rezoning of the served area to allow development at a greater density than that which existed before the system of sewerage was created.
