    On page 2, line 30, after "but" strike "shall have no application to any final decision of the state supreme court" and insert "this act does not affect the Supreme Court’s  decision in favor of the class of King County public defenders and staff in Dolan v. King County, 172 Wn.2d 299 (2010).  The rights of the class of King County public defenders and staff in the Dolan case to public employees' retirement system enrollment and eligibility, and the remedies in the Dolan case, shall be determined not by this act, but by the law existing before this act as applied in the Dolan case.  The rights of the class of public defenders and staff in the Dolan case, now and in the future, shall be determined by the standards and principles in the law applied in the Dolan case."

EFFECT:   Language specifying that the clarification of the state retirement system employer definitions in the bill do not apply to any final decision of the Supreme Court of Washington are replaced with language specifying that the definitions do not apply to the Court's decision in Dolan v. King County, and the rights of the class of King County public defenders and staff in the suit to participate in the Public Employees' Retirement System established in the decision, now and in the future.
