    On page 19, line 15 of the amendment, after "(2)" insert "(a)"

    On page 19, after line 29 of the amendment, insert the following:

    "(b) If a power purchase agreement for coal transition power is terminated and the commission determines that ratepayers will be harmed by the termination of the power purchase agreement, then the commission may assess a surcharge on electricity consumed by state government agencies that are served by the electrical company that terminated the power purchase agreement."

EFFECT:   Authorizes the utilities and transportation commission (commission) to assess a surcharge on electricity consumed by state government agencies that are served by the electrical company that terminates a power purchase agreement, if the commission determines that ratepayers will be harmed by the termination of the power purchase agreement.
