On page 41, line 22, after "based on" strike "evidence of the parties' intent" and insert "the factors listed in RCW 26.09.187(3) and 26.09.191. The party having physical custody of the child may retain physical custody of the child until the superior court orders otherwise"
EFFECT: Restores current law regarding the determination of custody of a child in a surrogacy dispute.
