On page 41, beginning on line 28, after "(b)" strike all material through "pregnancy" on line 30 and insert "The woman acting as a surrogate may not be held liable in any tort action for her decision or action regarding her health, welfare, or pregnancy so long as her actions are not criminal"
EFFECT: Clarifies that a surrogate is provided tort protection for any decision regarding her health, welfare, or pregnancy, not just her health and welfare. As previously drafted, a surrogate could be held liable for her decisions if those decisions were not made on the basis of either her health or welfare.
