On page 1, beginning on line 14 of the amendment, strike all of section 2 and insert the following:
"NEW SECTION. Sec. 2 (1) A county may adopt an ordinance to
restrict the sale and use of a coal tar pavement product by: (a) A
two-thirds majority vote by a county legislative authority or county
council; or (b) approval by a vote of the people of the county.
(2) A county ordinance to ban wholesale or retail sales of a coal
tar pavement product that is labeled as containing coal tar may not
take effect until January 1, 2012.
(3) A county ordinance to ban the use or application of a coal tar
pavement product on a driveway or parking area may not take effect
until July 1, 2012."
EFFECT: Removes the statewide ban on the sale and use of coal tar pavement products and authorizes counties to adopt ordinances to ban the sale and use of coal tar pavement products.
