On page 7, after line 3, strike all of section 4 and insert the following:
"NEW SECTION. Sec. 4 The joint legislative audit and review
committee, in consultation with the department of health, must conduct
a study on the long-term health care costs associated with the
provisions of this act. The joint legislative audit and review
committee and the department of health must report the findings of the
study required under this section to the appropriate committees of the
legislature by January 1, 2012.
NEW SECTION. Sec. 5 Sections 1 through 3 of this act take effect
January 1, 2012, if it is reported in the study required under section
4 of this act that the net present value of the long-term health care
costs are less than the fee revenue generated by the provisions of this
act.
NEW SECTION. Sec. 6 The joint legislative audit and review
committee must provide written notice of the effective date of sections
1 through 3 of this act to affected parties, the chief clerk of the
house of representatives, the secretary of the senate, the office of
the code reviser, and others as deemed appropriate by the department."

On page 1, line 3 of the title, after "82.26 RCW;" strike the remainder of the title and insert "creating new sections; and providing a contingent effective date."
EFFECT: Requires the Joint Legislative Audit and Review Committee, in consultation with the Department of Health, to conduct a study on the long-term health care costs associated with the act and deliver their findings to the legislature no later than January 1, 2012. If the costs are greater than the fee revenue generated, the act does not take effect.
