Background: Any retired teacher or administrator, who reenters service in any public educational institution in Washington State at least one calendar month after his or her accrual date, stops receiving pension payments while engaged in the service after rendering service for more than 867 hours in a school year. Any retired teacher or administrator who reenters service in any public educational institution in Washington State one and one-half calendar months or more after his or her accrual date and:

When a retired teacher or administrator renders service beyond 867 hours, the Department of Retirement Systems collects the applicable employer retirement contributions for the entire duration of the member's employment during that fiscal year.

Summary of Bill: The postretirement employment provisions are clarified to apply when a retired teacher or administrator reenters service with either an institution of higher education in an instructional capacity or any school or educational service district.

Staff Summary of Public Testimony: PRO: This bill is brought to correct an unintentional consequence. Employees who are not rehired in an instructional capacity at an educational institution should be subject to the same rules as other state employees rather than those intended to apply to faculty and teachers.
