Modifies alcohol violation provisions relating to: (1) Day-for-day credit for the time period in which a person kept an ignition interlock device installed;

(2) Requirement to install ignition interlock device for reckless driving, negligent driving, or participation in a deferred prosecution program;

(3) Alcohol monitoring same time period as mandatory license suspension or revocation;

(4) Increasing the mandatory minimum jail term for first-time DUI offenders and requiring the offender to pay the cost of incarceration.

(5) Prior offenses with regard to vehicular homicide and vehicular assault; and

(6) Enhancements to the standard sentence range for vehicular homicide.

Preserving the school district levy base.


(DIGEST OF PROPOSED 1ST SUBSTITUTE)


Finds that: (1) The federal education jobs fund was intended to support teachers' jobs and enhance quality education; and

(2) In 2010, the legislature cut state education funding to school districts by an amount equal to the districts' allocation from the education jobs fund.

Declares an intent to preserve the districts' levy base by including in the levy base an amount equivalent to the district's education jobs fund allocation.

Expires January 1, 2018.

Requires all individuals applying for first-time agency licenses, all new employees, and other persons who have not been previously qualified by the department of early learning to have unsupervised access to children in care to be fingerprinted and obtain a criminal history record check.

Requires those individuals to pay the costs of the fingerprinting and record checks.

Requires the department of early learning to issue a background check clearance card or certificate to an applicant if the department concludes the applicant is qualified for unsupervised access to children in care.

Establishing a health benefit exchange.


(DIGEST OF PROPOSED 1ST SUBSTITUTE)


Requires the state to establish a health benefit exchange consistent with the federal affordable care act to begin operations no later than January 1, 2014.

Establishes the health benefit exchange board.

Requires the health benefit exchange board and the state health care authority, in consultation with the joint select committee on health reform implementation, to: (1) Apply for planning and establishment grants pursuant to the affordable care act;

(2) Implement provisions of the planning and establishment grants as approved by the United States secretary of health and human services; and

(3) Develop a broad range of options for establishing and implementing a state-administered health benefit exchange and develop a work plan for the development of those options.

Authorizes the state health care authority to enter into: (1) Information sharing agreements with federal and state agencies and other state exchanges; and

(2) Interdepartmental agreements with the office of the insurance commissioner, the department of social and health services, the department of health, and certain other state agencies.

Consolidating natural resources agencies and programs.


(DIGEST OF PROPOSED 1ST SUBSTITUTE)


Creates the department of fish, wildlife, and recreation as an executive branch agency.

Transfers the following to the department of fish, wildlife, and recreation: (1) The law enforcement program and employees of the department of natural resources;

(2) The pollution liability insurance agency (expires June 1, 2013);

(3) The powers, duties, and functions of the department of fish and wildlife;

(4) The powers, duties, and functions of the law enforcement program of the department of natural resources;

(5) The powers, duties, and functions of the state parks and recreation commission; and

(6) The powers, duties, and functions of the recreation and conservation office.

Merges the pollution liability insurance program established by chapter 70.148 RCW (underground petroleum storage tanks) and chapter 70.149 RCW (heating oil pollution liability protection act) into the department of fish, wildlife, and recreation. Expires June 1, 2013.

Transfers the reclaimed water program from the department of health to the department of ecology.

Transfers the site use permit program from the department of ecology to the department of health.

Requires the department of ecology to provide administrative and functional assistance to the Columbia River Gorge commission.

Requires the secretary of the department of health and the directors of the department of ecology, the pollution liability insurance agency, and the Columbia River Gorge commission to each designate one executive-level representative to serve on a consolidation transition team.

Requires the code reviser to: (1) Note wherever the director or department of fish and wildlife, the director or recreation and conservation office, and the director or parks and recreation commission is used or referred to in statute that the name of the department or office has changed; and

(2) Prepare legislation for the 2012 regular legislative session that changes the appropriate statutory references.

Making a health savings account option and high deductible health plan available to public employees. (REVISED FOR ENGROSSED: Making a health savings account option and high deductible health plan option and a direct patient-provider primary care practice option available to public employees. )

Requires the public employees' benefits board, for the open enrollment period beginning November 1, 2011, to: (1) Offer a health savings account option for employees; and

(2) Offer a high deductible health plan in conjunction with a health savings account.

Requires the state health care authority to: (1) Include in its provider network for a self-insured health benefit plan a direct patient-provider primary care practice; and

(2) Use best efforts to enroll at least one thousand members residing in King, Pierce, or Thurston counties.

Prohibits direct practices from submitting a claim for payment, other than the direct fee and any other negotiated ancillary costs, to certain plans for health care services provided to direct patients as covered by their agreement.

Finds that collaboration on ocean and coastal resource management between Washington, Oregon, and California should be continued and enhanced through the respective legislatures, as well as through the respective executive branches through the west coast governor's agreement on ocean health.

Requires the governor, when money is deposited into the marine resources stewardship trust account, to provide to the appropriate committees of the legislature before the next regular legislative session, recommendations on the allowable uses of the account and the priority areas identified in the west coast governor's agreement on ocean health.

Encourages the parties to the collective bargaining agreements to reconvene to reach an agreement that takes into account the legislature's concerns and better recognizes the state's fiscal situation.
