Beginning on page 7, line 13, strike all of subsections (1) through (4)
Renumber the remaining subsections consecutively and correct any internal references accordingly.
On page 9, after line 23, insert the following:
"(7) It is the intent of the legislature to not delegate ferry fare
or toll rate setting but to retain the authority to set fees as set
forth in Initiative Measure No. 1185 as adopted by the voters in the
November 6, 2012, general election."
Beginning on page 87, line 30, after "(1)" strike all material
through "(3)" on page 88, line 13 and insert "((Consistent with RCW
43.135.055, 47.60.290, and 47.60.315, during the 2011-2013 fiscal
biennium, the legislature authorizes the transportation commission to
periodically review and, if necessary, adjust the schedule of fares for
the Washington state ferry system only in amounts not greater than
those sufficient to generate the amount of revenue required by the
biennial transportation budget. When adjusting ferry fares, the
commission must consider input from affected ferry users by public
hearing and by review with the affected ferry advisory committees, in
addition to the data gathered from the current ferry user survey.)) It is the intent of the legislature to not delegate ferry
fare or toll rate setting but to retain the authority to set fees as
set forth in Initiative Measure No. 1185 as adopted by the voters in
the November 6, 2012, general election.
(2) Consistent with RCW 43.135.055 and 47.46.100, during the
2011-2013 fiscal biennium, the legislature authorizes the
transportation commission to periodically review and, if necessary,
adjust the schedule of toll charges applicable to the Tacoma Narrows
bridge only in amounts not greater than those sufficient to support (a)
any required costs for operating and maintaining the toll bridge,
including the cost of insurance, (b) any amount required by law to meet
the redemption of bonds and applicable interest payments, and (c)
repayment of the motor vehicle fund.

EFFECT: Removes from the 2013-2015 fiscal biennium the
authorization from the legislature for the transportation commission to
periodically review and, if necessary, adjust the schedule of fares for
the Washington state ferry system to generate the amount of revenue
required by the biennial transportation budget and the toll setting on
the Tacoma narrows bridge, state route number 99, and the Columbia
river crossing corridor.
Removes from the 2011-2013 fiscal biennium the authorization from
the legislature for the transportation commission to periodically
review and, if necessary, adjust the schedule of fares for the
Washington state ferry system to generate the amount of revenue
required by the biennial transportation budget and the toll setting on
the Tacoma narrows bridge.
Clarifies that it is the intent of the legislature to retain toll
rate and ferry fare setting authority at the legislative level in
accordance with Initiative No. 1185 as adopted by the voters in
November 2012.
EFFECT: No net change to appropriated levels.
