On page 36, after line 6 of the amendment, insert the following:
     "The appropriation and reappropriation in this section are subject to the following conditions and limitations: Funds may not be expended to place a cover over the trenches which are releasing or are projected to release contaminants until the department has: (1) Completed the model toxics control act cleanup action plan pursuant to chapter 70.105D RCW and accompanying environmental impact statement processes pursuant to WAC 173-340-380 and 197-11-262; and (2) either demonstrated that the cover will meet relevant standards under the model toxics control act for cancer risk from exposure to all carcinogens, including uranium, or that there are no preferable alternatives or mitigation measures which would reduce exposures."
