On page 1, beginning on line 17 of the amendment, after "section," strike all material through "section." on line 26 and insert "tree seed and seed of woody species are not included."

EFFECT: (1) Eliminates the forty pound lot threshold, so that state agencies are obligated to require suppliers of seed to ensure the identity and purity of seed through appropriate testing regardless of whether the contract is for the purchase of seed in a lot or lots that exceed forty pounds; and

(2) Eliminates the seed of wildflowers that are native to Washington and that are harvested from naturally occurring stock from the list seeds that are exempted from both the testing requirement and the requirement that contracts include an agency's expectations for the germination or viability of the seed as an essential element of the supplier's performance under the contract.
