    On page 7, after line 25, insert the following:

    "(10) The prevailing party in any action alleging a construction defect shall be entitled to recover the costs of the action including a reasonable attorneys' fee."

EFFECT:   Provides that the prevailing party in a construction defect action shall be entitled to recover the costs of the action including a reasonable attorneys' fee.
