     On page 2, beginning on line 39, after "(7)" strike all material through "reasons" on page 3, line 3 and insert "((This section does not apply to an operator or passenger who possesses written verification from a licensed physician that the operator or passenger is unable to wear a safety belt for physical or medical reasons))  This section does not apply to:

(a) An operator or passenger, except for an operator or passenger of a commercial motor vehicle as defined in RCW 46.32.005, who possesses written verification from a licensed physician that the operator or passenger is unable to wear a safety belt for physical or medical reasons; and

(b) A passenger, except for a passenger of a commercial motor vehicle as defined in RCW 46.32.005, who is unable to wear a safety belt for physical reasons and does not possess written verification from a licensed physician"

EFFECT: Removes an exemption from safety belt use for physical or medical reasons for operators or passengers of a commercial motor vehicle to match federal code.  Exempts a passenger who is unable to wear a safety belt for physical reasons and does not possess written verification from a licensed physician from a requirement to wear a safety belt.
