    On page 17, line 22, after "(a)" insert "The respondent is sixteen or seventeen years of age at the time of the proceedings and the alleged offense is:

    (i) Robbery in the first degree or drive-by shooting;

    (ii) Burglary in the first degree and the respondent has a criminal history consisting of one or more prior felony or misdemeanor offenses; or

    (iii) Any violent offense as defined in RCW 9.94A.030, and the respondent is alleged to have been armed with a firearm;

    (b)"

 

    Renumber the remaining subsections consecutively and correct any internal references accordingly.

 

 

    EFFECT:   Expands the circumstances when the prosecutor, respondent, or the court may file a discretionary decline motion requesting the court to transfer the respondent for adult criminal prosecution to include when a respondent is 16 or 17 at the time of the proceedings and the alleged offense is:

·   Robbery in the first degree or drive-by shooting;

·   Burglary in the first degree and the respondent has a criminal history consisting of one or more prior felony or misdemeanor offenses; or

·   Any violent offense as defined in RCW 9.94A.030, and the respondent is alleged to have been armed with a firearm.
