On page 3, line 6 of the striking amendment, after "agreement." insert "This subsection does not apply to any person who, as part of a release of claims, agrees to not be a relator in an action based on the same set of alleged facts."

EFFECT: Specifies that the restriction on use of a private agreement to limit qui tam actions does not apply to an individual that agrees in a release of claims not to be a qui tam relator.
