AN ACT Relating to calculating the benchmark rate for certain community residential services; adding a new section to chapter 71A.12 RCW; and creating a new section.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

NEW SECTION. Sec. 1. A new section is added to chapter 71A.12 RCW to read as follows:

(1) The department must use the King county classification for the purposes of determining the benchmark rate in Snohomish county for community residential service businesses as defined in RCW 74.39A.009(5).

(2) For purposes of this section, "benchmark rate" means the rate at which direct care staff hours are paid, specific to a county classification.

NEW SECTION. Sec. 2. If specific funding for the purposes of this act, referencing this act by bill or chapter number, is not provided by June 30, 2019, in the omnibus appropriations act, this act is null and void.
