AN ACT Relating to student transportation for students in out-of-home placements; and adding a new section to chapter
28A.160 RCW.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:
NEW SECTION. Sec. 1. A new section is added to chapter
28A.160 RCW to read as follows:
(1) If the department of children, youth, and families determines that a student residing in out-of-home care outside the student's school of origin district is not receiving transportation services to the student's school of origin for a week or more, the department of children, youth, and families must notify the school of origin district, the school district where the out-of-home care is located, and the office of the superintendent of public instruction.
(2) If within two weeks of notification the school districts notified under subsection (1) of this section do not provide the student with regular transportation services to the school of origin, the department of children, youth, and families must notify the office of the superintendent of public instruction, who must then deduct five hundred dollars per day from each notified school district from the next transportation allocation under RCW
28A.160.192 until regular transportation is provided to the student.
(3) This section does not apply if the department of children, youth, and families determines that remaining enrolled in the school of origin is not in the best interest of the student as determined under RCW
28A.225.350.
(4) For the purposes of this section, "out-of-home care" has the same meaning as in RCW
13.34.030.
