On page 3, line 8, after "(2)" insert "A person bringing a cause of action under subsection (1) of this section may not prevail in the action unless the person provides clear, cogent, and convincing evidence that the person complied with all lawful orders of the peace officer prior to the peace officer’s conduct as alleged in the cause of action.

Renumber the remaining subsections consecutively and correct any internal references accordingly.

EFFECT: Provides that a plaintiff may not recover in an action unless the person provides clear, cogent, and convincing evidence that the person complied with all lawful orders of the peace officer prior to the peace officer’s conduct as alleged in the cause of action.
