On page 2, after line 33, insert the following:

"(3) A person bringing a cause of action under subsection (1) of this section may not prevail in the action unless the person provides clear, cogent, and convincing evidence that the person complied with all lawful orders of the peace officer prior to the peace officer’s conduct as alleged in the complaint."

Renumber the remaining subsections consecutively and correct any internal references accordingly.

EFFECT: Requires a plaintiff bringing a claim against a peace officer pursuant to the underlying bill to establish - by clear, cogent, and convincing evidence - that the plaintiff complied with all lawful orders of the peace officer prior to the peace officer’s conduct as alleged in the complaint.
