On page 3, after line 20, insert the following:
"(10) If a city or county requires a home energy performance report pursuant to subsection (1) of this section, a property may be publicly advertised for sale without a home energy performance report if a qualified home energy auditor is not available to conduct the performance report within 10 business days of the request, so long as the home energy performance report is completed before the sale is finalized."

| EFFECT: Requires a city or county that adopts a home energy performance report requirement to allow low-income home sellers to obtain the required information from a utility company at no cost. Removes the option for cities and counties to require additional criteria on a home energy performance report. Allows a property to be listed for sale without a home energy performance report if a qualified home energy auditor is not available to conduct the assessment within 10 business days and the report is completed before the sale is finalized.
