On page 24, beginning on line 35 of the striking amendment, after "CONDUCT." strike all material though "practices" on page 25, line 5 and insert "Nothing in this chapter is intended to grant producers and other entities participating in the distribution chain of covered beverage containers under this chapter immunity from federal or state antitrust liability. A producer, producer responsibility organization, or other entity in the distribution chain of covered beverage containers is not exempted from state or federal laws prohibiting actions that are considered to be a restraint of trade, a conspiracy, or are otherwise deemed unlawful activities in violation of federal or state antitrust laws"
| EFFECT: Strikes provisions that exempt activities associated with producer responsibility organization duties from state antitrust laws. Provides that producers, producer responsibility organizations, and other entities in the distribution chain of covered beverage containers are not exempt from state or federal antitrust laws.
