On page 3, line 19 of the striking amendment, after "(12)" insert ""De minimis producer" means a producer that:

(a) In its most recent fiscal year introduced into commerce in this state less than one ton of covered beverage containers;

(b) Has a global gross revenue, not including on-premises alcohol sales, for the prior fiscal year of:

(i) Until January 1, 2031, less than $5,000,000; or

(ii) Beginning January 1, 2031, less than $5,000,000, as adjusted for inflation. The department must use the consumer price index for urban wage earners to calculate the annual rate of inflation adjustment effective January 1st of each year, beginning January 1, 2031.
