On page 3, after line 4, insert the following:
"(3) Except as provided in subsection (4) of this section, nothing in this section is intended to, or does:
(a) Create a private right of action against any person, legal entity, government agency, or the state, based on compliance or noncompliance with the provisions of the Washington wildlife habitat connectivity action plan and integrated wildlife habitat connectivity strategy; or
(b) Create any independent basis for liability against any person, legal entity, government agency, or the state.
(4) Subsection (3) of this section does not apply to any private right of action for damages related to:
(i) Construction of a project; or
(ii) Occurrences associated with the completion of a wildlife crossing structure."
On page 6, after line 4, insert the following:

| EFFECT: Limits the liability of and the bringing of a private right of action against any person, legal entity, government agency, or the state relative to compliance or noncompliance with the provisions of the Washington wildlife habitat connectivity action plan or integrated wildlife habitat connectivity strategy, except for actions arising from construction of a project or occurrences associated with the completion of a wildlife crossing structure.
