On page 5, line 28 of the striking amendment, after "statutes." insert the following:

"NEW SECTION. Sec. 2. A new section is added to chapter 36.27 RCW to read as follows:

(1) A county prosecuting attorney is authorized to investigate possible violations of the United States Constitution, Washington state Constitution, state statutes, ethical standards, or other impropriety by the office of the attorney general.

(2) In conducting an investigation under this section, a county prosecuting attorney may issue civil investigative demands, prior to institution of a civil proceeding, for documents, oral testimony, and answers to written interrogatories when the prosecuting attorney believes a person or entity:

(a) May be in possession, custody, or control of any original or copy of any book, record, report, memorandum, paper, communication, tabulation, map, chart, photograph, mechanical transcription, or other tangible document or recording, wherever situate, which he or she believes to be relevant to the subject matter of an investigation of a possible violation under subsection (1) of this section; or

(b) May have knowledge of any information which the prosecuting attorney believes relevant to the subject matter of such an investigation.

(3) A demand issued under this section is subject to the requirements and procedures applicable to civil investigative demands issued under section 1 of this act."

EFFECT: Authorizes county prosecutors to investigate potential violations of the state and federal constitutions, state statutes, ethical standards, or other impropriety by the Office of the Attorney General. Authorizes the county prosecutor to issue civil investigative demands when conducting such investigations.
