On page 11, after line 15 of the striking amendment, insert the following:

"NEW SECTION. Sec. 7. A new section is added to chapter 28A.150 RCW to read as follows: Within amounts appropriated through the distribution formulas established under RCW 28A.150.260, RCW 28A.150.390, and RCW 28A.160.150 through RCW 28A.160.192, the superintendent of public instruction may reserve amounts up to $5,000,000 for each fiscal year to be used for increased costs that are directly attributable to defending lawsuits related to the state funding of basic education."

Renumber the remaining sections consecutively and correct any internal references accordingly.

EFFECT: Allows the Office of the Superintendent of Public Instruction to reserve up to $5,000,000 of basic education, special education, and transportation allocations to use for increased costs directly attributable to defending lawsuits related to the state funding of basic education.
