On page 43, after line 2 of the striking amendment, insert the following:

"NEW SECTION. Sec. 713. A new section is added to chapter 4.24 RCW to read as follows:

A person may bring a civil action for damages against the state for the improper or incorrect assessment of taxes imposed under this act. The person may bring the action in Thurston county superior court or in the superior court of the person's residence. A person who prevails in an action brought under this section is entitled to actual damages, expenses, and reasonable attorney's fees."

EFFECT: Allows a person to bring a civil action for damages against the state for the improper or incorrect assessment of taxes imposed under the act. Entitles a person who prevails in such an action to actual damages, expenses, and reasonable attorney's fees.
