On page 3, after line 17, insert:
"
(4) Nothing in subsection (1) of this section prohibits health care facilities, including hospitals, from distributing or using drug testing equipment. Health care facility staff taking samples of substances and using drug testing equipment for the purpose of analyzing the composition of the substances or detecting the presence of certain substances are acting legally and are exempt from arrest and prosecution under RCW 69.50.4011(1) (b) or (c), 69.50.4013, 69.50.4014, or 69.41.030(2) (b) or (c)."
EFFECT: Permits health care facilities to distribute and use drug testing equipment. Exempts health care facility staff using drug testing equipment from arrest and prosecution under statutes criminalizing possession or use of counterfeit substances, possession or use of controlled substances, possession of 40 grams or less of cannabis, or possession or use of a legend drug without a prescription.
