EFFECT: Allows a law enforcement officer to arrest a person for possession or use of a controlled substance or possession of 40 grams or less of cannabis where that person is seeking medical assistance for an overdose.
Exempts the property of a person seeking medical assistance for an overdose from civil forfeiture only when that property was seized incident to an arrest for possession of a controlled substance or possession of 40 grams or less of cannabis, unless the property was in plain sight.
Exempts a person seeking medical assistance for an overdose from being penalized for failing to appear only when they failed to appear on a charge of possession or use of a controlled substance or possession of 40 grams or less of cannabis.
