On page 5, after line 2, insert the following:
"
NEW SECTION. Sec. 7. A new section is added to chapter
90.48 RCW to read as follows:
Criminal charges under this chapter may not be filed unless the department has issued a written notice of violation to the person alleged to have violated this chapter and the person has failed to take corrective action within 30 days of receiving the notice."
Renumber the remaining sections consecutively and correct any internal references accordingly.
On page 13, after line 16, insert the following:
"
NEW SECTION. Sec. 13. A new section is added to chapter
70A.15 RCW to read as follows:
Criminal charges under this chapter may not be filed unless the department has issued a written notice of violation to the person alleged to have violated this chapter and the person has failed to take corrective action within 30 days of receiving the notice."
Renumber the remaining sections consecutively and correct any internal references accordingly.
On page 16, after line 18, insert the following:
"
NEW SECTION. Sec. 18. A new section is added to chapter
70A.300 RCW to read as follows:
Criminal charges under this chapter may not be filed unless the department has issued a written notice of violation to the person alleged to have violated this chapter and the person has failed to take corrective action within 30 days of receiving the notice."
Renumber the remaining sections consecutively and correct any internal references accordingly.
EFFECT: Specifies that criminal charges may not be filed under the state Water Pollution Control Act, Clean Air Act, or Hazardous Waste Management Act unless the Department of Ecology has issued a written notice of violation to the alleged violator and that person has failed to take corrective action within 30 days of receiving the notice.
